The PORT, in it; sole discretion, «'ill determine whether tne Bidder is a <br /> responsible Biddc*based on the follow�ing qualifications cnteria: <br /> + 1. The ability, capacity and skill of the Bidder to perform the contract or <br /> � provide che service or Work within the time required; <br />� � ?, The character, inteerity, reputation, and efficiency of the Bidder; <br /> 3. The quality and tirneliness of perfonnance by the Bidder of previous <br /> contracts with the POR'T or other entities; <br /> � 4. The previous and existing compliance by the Bidder with laws relatin; ro <br /> puUlic contracts; and <br /> 5. Such other infornation havinc a bearing on wbether the Bidder is <br /> i responsible. <br /> B. At the PORT's request, the Bidder shall submit qualifications infoi7nation <br /> regarding the Bidder, its key personnel, and subcontractors and suppliers as <br /> I requested by the PORT. In the event a Bidder refuses to provide requested <br /> ' additional qualifications infom�ation, the Bidder's Bid Guaranty may be subject to <br /> forfeimre and the Bid may be determined to Ue non-responsive. <br /> 1 C, The PORT reserves dle rieht to investigate the qualifications of any Bidder, <br /> includirg but not limited to, contacting any reference or any financial institution <br /> to verify that the Bidder is yualified to successfully complete the Work. <br /> � D. In order to verify that tl�e Bidder has adequately incorporated all elements of the <br /> Work and the reGuirements of the Contract Documents in its bid prices, the <br /> � Bidder will make available for thc PORT's review a complete itemization of its <br /> Bid and clearly define all pl�ases of its Work, if requested by[he PORT. <br /> L-. Prior to award, if requested by the PORT, the Bidder and selected proposed <br /> r subcontractors or suppliers shall attend a bid evaluatio� conf_rence and shall <br /> Ibring to the confemnce any documents requested by the PO.2T to evaluate the Iiid <br /> and the Bidder's qualifications. <br /> 3.6 Collusion <br />' I If the PORT detennines that collusion has occurred among the Bidders, none of the Bids <br /> � of the participants in such collusion will Ue considered.
