February 1 , 1989 35 <br /> WHEREAS, the City Council finds that the owner of the <br /> property is aware of the Order; and <br /> WHEREAS, the City Council finds that the owners have been <br /> given notice of this Council meeting; and <br /> WHEREAS, the City Council finds that there has been no appeal <br /> of the Order issued by the Planning Director and that the appeal <br /> period has expired; and <br /> WHEREAS, the City Council, upon due consideration, deems it <br /> in the best interest of the health, safety and welfare of the public <br /> that this Resolution be adopted requiring the demolition of the <br /> building; <br /> NOW� THEREFORE, BE IT RESOLVED BY THE CITY OF EVERETT: <br /> Section 1: That the building located at 1414 12th Street <br /> which is legally descriued as follows contains conditions which are <br /> hazardous to the life, limb, health, safety , welfare , and property <br /> of the public or the occupants thereof: <br /> The West 48 feet of Lots 17 and 18, and the West 48 feet of <br /> the North 1/2 of Lot 19, in Block 227, Supplemental Plat <br /> Church and laMoure's Addition to Everett, as per plat in <br /> Volume 3 of P12ts on page 35, records of Snohomish County ; <br /> Situate in the County of Snohomish, State of Washington. <br /> I <br /> Section 2: That the above-described property is hereby I <br /> declared to be substandard and a hazardous nuisance as defined in , <br /> the Uniform Housing Code. I <br /> Section 3: That a11 expenses incurred as a result of the <br /> demolition of the biailding sha11 be made a personal obligation of <br /> the property owners or assessed against the property, in which case <br /> enter the amount of the assessment upon the tax rolls against the I <br /> property and collect the same with regular property taxes, and Nith <br /> =nterest at such rate as provided for in RCW B4.Sb.020. <br /> Section 4: That the Planning Director is hereby authorized j <br /> to have the building demolished. � <br /> Section 5: The demolitior. shall not be commenced until not I <br /> less than ten 10) days after the notification by personal service <br /> or by mailing via registered or certified mail of notice of the <br /> herein described Everett City Council Resolution to th� owners of <br /> the herein described property . <br /> Foll was called with a11 councilmzmbers voting yes. <br /> D�otion carried . <br />
