The Contractor shall be <br /> liable for all acts and ommisions of his subcontractor(s). i <br /> (6) Payment of the City shall be made as follows: After the <br /> expiration of thirty (30) calendar days following the final <br /> acceptance of said work and the expiration of the time for filing <br /> of lien claims as provided by law, full amount of contract price, <br /> less all amounts necessary to meet and discharge the claims as <br /> provided by law, together with a sum sufficient to defray the <br /> cost of such action and to pay attorney' s fees , shall be paid to <br /> the Contractor. <br /> (7) The City cf Everett is authorized to deduct and retain out of the <br /> monies which may be due and become due to the Contractor under <br /> this Contract, as damages for the non-completion of the work <br /> aforesaid within the time hereinbefore stipulated for its <br /> completion, or within such further times as in accordance with <br /> the provisions of the Contract, shall be fixed or allowed for <br /> such performance or cnrnple:ion, the sum of Fifty Dollars (&50) <br /> for each and every day the �ime employed upon said work may be <br /> increased as hereinafter provided, said sum of Fifty Dollars <br /> (E50) per day being hereby, in view of the difficulty of <br /> estimating such damages, agreed upon, fixed and determined <br /> between the parties hereto, as the liquidated damages that the <br /> City of Everett may suffer by reason of such default, and not by <br /> way of penalty. <br /> (8) Prior to the demolition or removal of any structure, side sewers <br /> or private sewer iines connected to the public sewer system shall <br /> be capped at the property line or as directed by the City' s <br /> Public Works Department. <br /> (9) It is hereby expressly agreed by and between the parties hereto <br /> that in any matter•, dispute, suit or proceedings arising or in <br /> any way growing out of this Contract in which it may be necessary <br /> to introduce into evidence the original of such standare+s, plans <br /> and specifications, that a printed copy thereof may be used in <br /> lieu• thereof with like force and effect as though the original <br /> was produced. <br /> i10i The Contractor further agrees to save the City, its officers, <br /> employees and agents harmless from all loss, damage or injury, <br /> including death, occasioned to it or to any third person or <br /> property by reason of any acts or omissions on the part of the <br /> Contracior, subcontractor, agents, employees, or persons working <br /> directly or indirectly in the performance of the Contract and <br /> shall , after reasonable notice thereof, defend and pay the <br /> 3 <br /> A� <br />
