<br /> expense of defending any suit which inay be commenced against the
<br /> City, its officers, employees or agents by any third person
<br /> alleging injury by reason of such acts or omis�ions and will pay
<br /> any judgment n�hich may be obtained against the City, its
<br /> officers, employees or agents in such suit. The Contractor
<br /> agrees to repair and replace all property of the City and
<br /> property of others damaged or destroyed by himself, liis employees
<br /> and subcontractors and agents. This paragraph does not purport
<br /> to indemnify the City aaainst liability for damages arising out
<br /> of bodily injury or death to persons or damages to property
<br /> caused by or resulting from tne sole negligence of the Ctity, its
<br /> officers, employees, and agents ; PROVIDED, that if the claims or
<br /> damages are caused by or result from the concurrent negligence of
<br /> (a) the Contractor, its subcontractors, its agents or employees,
<br /> and (b) the City, its officers, employees or agents, this
<br /> indemnity provision shall be valid and enforceable only to tf;e
<br /> extent of the negligence of the Contractor, its subcontractors,
<br /> its agents or employees. (For example, where the Contractor is
<br /> 25% iiable, this indemnification shall extend to 25% of the
<br /> City's concurrent negligence, if any. )
<br /> (11 ) The Contractor expressly aarees to pay all premiums provided for
<br /> by the Workman's Compensation Act of the State of Washington.
<br /> (12) The Contractor further agrees to comply with the provisions of
<br /> RCW 39.16.005 concerniny percentage of resident employees.
<br /> (13) It is understood that the whole of the work under this Contract
<br /> is ta be done at the Contractor' s risk, and that he has
<br /> familiarized himself with the conditions of demolition,
<br /> excavation, backfill , materials, climatic conditions, and other
<br /> contingencies likely to affect the work, and has made his bid
<br /> accordingly, and that he is to assume the responsibility and risk
<br /> of all loss or damage to materials or work which may arise from
<br /> any cause whatsoever prior to completion.
<br /> (14) Contractor shall secure and maintain during the life of this
<br /> Contract minimum Public Liability and ?roperty Oamage Insurance
<br /> Coverage in the minimum amount of 5500,000 for death or injury to
<br /> any one person and E1 ,000,000 for death or injury to two or more
<br /> persons in any one occurrence and b100,000 for Property Damage in
<br /> any one occurrence with any aggregate Property Damage coverage of
<br /> $100,000 for two or more occurrences from an insurance co�npany
<br /> authorized to do business in the State of Washington. Said
<br /> insu�•ance coverage may be superseded by addenda or other
<br /> provisions of the Contract. City, its officers, employees and
<br /> agents shall be an additional named insured on said insurance in
<br /> a fcrm acceptable to the City Attorney.
<br /> ( 15) The Contractor shall secure all municipal , county or state
<br /> permits or licenses necessary or incident to the actual
<br /> performance of the work under this Contract, and shall , during
<br /> its progress, comply with all laws, ordinances, and governmental
<br /> regulations pertaining to carrying out of .the work.
<br /> (16' The Contractor shall not be entitled to any claim for damages or
<br /> of hindrances or delays from any cause whatsoever, but if
<br /> occasioned by any act of God, or by any act or omission on the
<br /> part of the City, such act, hindrance, or delay may entitle the
<br /> Contractor to an extension of time in which to complete the work
<br /> whicr shall be determined by the duilding Official , PROVIDED THAT
<br /> the Contractor will give notice in writing of the cause of such
<br /> act, hindrance, or delay �aithin ten (10) days after its
<br /> occurrence.
