/1?/% 7A1 <br /> SETT <br /> RESOLUTION NO. 4450 <br /> A RESOLUTION DECLARING AN EMERGENCY <br /> REGARDING <br /> EFFLUENT IMPROVEMENTS PIPELINE REPLACEMENT PROJECT <br /> Whereas, the City of Everett has wastewater ponds located on the east side of Interstate 5; and <br /> Whereas, the City of Everett has an existing pipeline from the City's wastewater ponds on the <br /> east side of I-5 to the west side of I-5; and <br /> Whereas,the existing pipeline is highly corroded and is in a crushed condition; and <br /> Whereas,the condition of the existing pipeline resulted in overflows of wastewater onto <br /> surrounding properties during the winter of 1996-1997; and <br /> Whereas, the existing pipeline has failed on at least one occasion resulting in a sinkhole on the <br /> shoulder of I-5; and <br /> Whereas,this has created a dangerous situation as additional failures may occur which may <br /> include failures under Interstate 5; and <br /> Whereas, on October 30, 1996, a contract to perform work was awarded to Frank Coluccio <br /> Construction Company, Inc., to install a new effluent pipeline from the wastewater ponds for the <br /> City's Water Pollution Control facility located east of I-5 to the west side of I-5; and <br /> Whereas, earlier this month Frank Coluccio Construction Company was notified that it was in <br /> default for failure to proceed with the installation of the pipeline; and <br /> Whereas,Frank Coluccio Construction Company in response to the Notice of Default has filed a <br /> lawsuit against the City of Everett under Snohomish County Cause No. 97-2-04252-4; and <br /> Whereas,Frank Coluccio Construction Company has failed to proceed with the pipeline <br /> installation; and <br /> Whereas,the City of Everett has terminated the contract with Frank Coluccio Construction <br /> Company for cause; and <br /> 1 <br />
