RESOLUTION NO. 4390 <br /> RESOLUTION OF INTENT TO REZONE <br /> "KANERIS PROPERTY" LOCATED AT 2225 116TH STREET SE <br /> FROM R-1 TO B-1 <br /> WHEREAS, George Kaneris filed an application to rezone property located at 2225 <br /> 116th Street SE from R-1 (Single Family Detached Low Density) to B-1 (Neighborhood <br /> Shopping) for the purpose of establishing a retail shopping center development, the legal <br /> description of which is: <br /> The north 125 feet of Lots 5, 6 and 7 of the Re-Plat of Lots 14 and 15, Block 1, <br /> Plat of Silver Lake, as per plat recorded in Volume 9 of Plats, Page 77, Records of <br /> Snohomish County. Situate in Section 20, T. 28 N., R. 5 E., Willamette Meridian, in the <br /> County of Snohomish, State of Washington. <br /> and <br /> WHEREAS, the proposed development of the subject with commercial buildings could <br /> have a detrimental impact on the single family residential zoned property abutting subject <br /> property to the south; and <br /> WHEREAS, the Planning Commission, after holding a public hearing, did adopt certain <br /> Findings, and recommened to the City Council that the proposed rezone be approved <br /> pursuant to the provisions of Section 41.160.D.7 of Ordinance No. 1671-89, as amended, <br /> and subject to the specific conditions set forth in said recommendation; and <br /> WHEREAS, the City of Everett, hereinafter referred to as "City," finds that by <br /> establishing certain standards for the development of the property to be rezoned, that the <br /> residential property abutting to the south of the subject property can be adequately <br /> protected from the impacts of commercial use of the property to be rezoned; and <br /> WHEREAS, the Everett Zoning Code provides a mechanism by which the City and <br /> property owner may enter into a "performance agreement" wherein the proponent of a <br /> rezone agrees to develop property according to the terms of the agreement before the <br /> rezone is finalized by the City; and <br /> WHEREAS, the City Council finds that: <br />
