1. The proposed rezone is consistent with the Comprehensive Plan; <br /> 2. The proposed rezone bears a substantial relation to the public health, safety and <br /> welfare; <br /> 3. The proposed rezone promotes the best long term interests of the Everett community, <br /> and <br /> 4. The terms of the resolution are sufficient to mitigate the impacts of the proposed <br /> rezone. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Everett <br /> declares its intent to rezone property located at 2225 116th Street SE, a vicinity map of <br /> which is attached hereto as Exhibit "A," from R-1 (Single Family Detached Low <br /> Density) to B-1 (Neighborhood Shopping), pursuant to the provisions of Section 41.160 <br /> of Ordinance No. 1671-89, as amended, and the Council shall by Ordinance, effect such <br /> rezone upon being advised that all of the following conditions, stipulations, limitations, <br /> and requirements contained in this Resolution have been met: <br /> 1. The future development of the subject property be permitted only as part of an <br /> integrated redevelopment with adjoining B-1 zoned properties, to be further reviewed <br /> through the City's shoreline permit process. <br /> 2. There shall be no vehicular or pedestrian access permitted to the site through the <br /> abutting single family zoned property (Hauff property) located south of the subject <br /> property. <br /> 3. The south boundary of the subject property (abutting the Hauff property) shall be <br /> fenced with a solid fence eight feet in height constructed with a 6 foot wood fence on a 2 <br /> foot concrete or masonry base. <br /> 4. The 10 foot wide landscape buffer abutting the property to the south of the subject <br /> property shall be planted with landscaping with trees having a mix of evergreen and <br /> deciduous trees forming a more substantial visual buffer than Type II landscaping would <br /> provide. Trees shall be a minimum height of 8 feet at the time of planting. <br /> 5. The height of the commercial building on the subject property be limited to 19 <br /> feet, with architectural accents or features used to modulate the front facade of the <br /> building allowed to have a height of up to 28 feet. <br /> 6. The parking area proposed on the east side of the subject property have a <br /> minimum setback of 18 feet from the south property line (abutting the Hauff property),to <br /> be landscaped as described above in Condition#4. <br /> 7. Construction must be commenced within two (2) years of the date of issuance of <br /> the shoreline permit. An extension of time may be authorized as provided by the State <br /> Shoreline regulations. Construction of buildings and of the site improvements required <br /> by this Resolution shall be completed within five years of the date of issuance of the <br /> 2 <br />
