2 FINDINGS OF FACT 1. Liquidation Properties Inc., Respondent, is the owner of record of property at 1215 Everett Avenue, Everett, Washington (property). The property is in an R-5 Core Residential zone as established by the City of Everett. (Exhibit #9, Snohomish County Assessors Record dated May 26, 2015) (Exhibit #10, Go Sync Maps) 2. On April 7, 2015, City of Everett Code Enforcement (ECE) Officer Kevin Fagerstrom conducted an inspection of the property and observed the residential structure on site was vacant and open to trespass. On April 8, 2015, ECE Officer Fagerstrom issued an Order of the City of Everett Code Official to the Respondent which required that the vacant structure be secured from trespass by April 13, 2015. On April 9, 2015, ECE Officer Fagerstrom inspected the property and observed and photographed that the residential structure remained vacant, unsecured and open to trespass. However, there was evidence that the residential structure had been occupied because of food products and articles of clothing that had been left inside the residential structure. On April 10, 2015, the City issued the Respondent a violation citation for violations of International Property Maintenance Code (IPMC) 108.1.5(7) Dangerous Structure or Premises as adopted by EMC 16.005.010. Copies were mailed to the Respondent via first class and certified mail to the Respondents last known address which ECE Officer Fagerstrom obtained from Snohomish County Assessors Record. A copy of the citation was posted at the property. Each method of service used is independently sufficient to provide notice. ECE Officer Fagerstrom posted the property with a condemnation placard for vacant and unsecure structures. A notice of condemnation was mailed to the Respondent via first class mail and certified mail. The notice informed the Respondent of the violations present on the property and cited that the structure must be vacated immediately and secured from trespass. On April 20, 2015, the City secured the structures and stenciled the structures on the property with "no trespassing". On May 22, 2015, ECE Officer Fagerstrom reinspected the property and observed and photographed that the residential structure was secured from trespass.
