2 <br />FINDINGS OF FACT <br />1. Liquidation Properties Inc., Respondent, is the owner of record of property at 1215 <br />Everett Avenue, Everett, Washington (property). The property is in an R-5 Core <br />Residential zone as established by the City of Everett. (Exhibit #9, Snohomish <br />County Assessors Record dated May 26, 2015) (Exhibit #10, Go Sync Maps) <br />2. On April 7, 2015, City of Everett Code Enforcement (ECE) Officer Kevin Fagerstrom <br />conducted an inspection of the property and observed the residential structure on <br />site was vacant and open to trespass. On April 8, 2015, ECE Officer Fagerstrom <br />issued an Order of the City of Everett Code Official to the Respondent which <br />required that the vacant structure be secured from trespass by April 13, 2015. <br />(Exhibit #6, Order of the City of Everett Code Oficial dated April 8, 2015 with mail <br />receipts) (Testimony of Code Enforcement Officer Fagerstrom) <br />3. On April 9, 2015, ECE Officer Fagerstrom inspected the property and observed and <br />photographed that the residential structure remained vacant, unsecured and open <br />to trespass. However, there was evidence that the residential structure had been <br />occupied because of food products and articles of clothing that had been left inside <br />the residential structure. On April 10, 2015, the City issued the Respondent a violation citation for violations <br />of International Property Maintenance Code (IPMC) 108.1.5(7) Dangerous Structure <br />or Premises as adopted by EMC 16.005.010. Copies were mailed to the <br />Respondent via first class and certified mail to the Respondents last known address <br />which ECE Officer Fagerstrom obtained from Snohomish County Assessors <br />Record. A copy of the citation was posted at the property. Each method of service <br />used is independently sufficient to provide notice. ECE Officer Fagerstrom posted the property with a condemnation placard for <br />vacant and unsecure structures. A notice of condemnation was mailed to the <br />Respondent via first class mail and certified mail. The notice informed the <br />Respondent of the violations present on the property and cited that the structure <br />must be vacated immediately and secured from trespass. On April 20, 2015, the <br />City secured the structures and stenciled the structures on the property with "no <br />trespassing". On May 22, 2015, ECE Officer Fagerstrom reinspected the property and observed <br />and photographed that the residential structure was secured from trespass.
