The City provided the Respondent with an opportunity to correct the conditions that were in violation of sections of the EMC, provided a corrective action date of April 13, 2015 and provided notice of the date, time and place of this hearing. The Respondent failed to appear at the hearing. Based on the above Findings of Fact, the Violations Hearing Examiner enters the following Conclusions: CONCLUSIONS OF LAW Jurisdiction: Pursuant to Chapter 1.20 EMC or any Everett Municipal Code (EMC) provisions that identify Chapter 1.20 EMC for enforcement, the Violations Hearing Examiner of the City of Everett has jurisdictional authority to hold this hearing and to issue the decision. EMC §1.20.020 Applicable Law: 1. IPMC 108.1.5(7) Dangerous Structure or Premises, which reads: For the purpose of this code, any structure or premises that have any or all of the conditions or defects described below shall be considered dangerous: (7) The building or structure is neglected, damaged, dilapidated, unsecured or abandoned so as to become an attractive nuisance to children who might play in the building or structure to their danger, becomes a harbor for vagrants, criminals or immoral persons, or enables persons to resort to the building or structure for committing a nuisance or an unlawful act. Conclusions of Law Based on Above Findines: 1. By allowing the structure to remain damaged and unsecured so as to become an attractive nuisance to children who might play in the building or structure to their danger, to become a harbor for vagrants, criminals, or immoral persons, the Respondent violated IPMC 108.1.5(7). ORDER Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby determined that the Respondent is in default and was in violation of IPMC 108.1.5(7) and is hereby ordered to: 1. The City abated all violations of IPMC 108.1.5(7) on property located at 1215 Everett Avenue, Everett, Washington. 2. The Respondent shall maintain the vacant structure on site from trespass and occupancy until occupancy is approved by the City of Everett Building Division. 3. The Respondent shall apply for and obtain all required City of Everett permits to bring the structure into compliance.
