7. The City provided the Respondent with an opportunity to correct the conditions that <br />were in violation of sections of the EMC, provided a corrective action date of April <br />13, 2015 and provided notice of the date, time and place of this hearing. The <br />Respondent failed to appear at the hearing. <br />Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br />following Conclusions: <br />CONCLUSIONS OF LAW <br />Jurisdiction: <br />Pursuant to Chapter 1.20 EMC or any Everett Municipal Code (EMC) provisions that <br />identify Chapter 1.20 EMC for enforcement, the Violations Hearing Examiner of the City <br />of Everett has jurisdictional authority to hold this hearing and to issue the decision. <br />EMC §1.20.020 <br />Applicable Law: <br />1. IPMC 108.1.5(7) Dangerous Structure or Premises, which reads: <br />For the purpose of this code, any structure or premises that have any or all of the <br />conditions or defects described below shall be considered dangerous: <br />(7) The building or structure is neglected, damaged, dilapidated, unsecured or <br />abandoned so as to become an attractive nuisance to children who might play <br />in the building or structure to their danger, becomes a harbor for vagrants, <br />criminals or immoral persons, or enables persons to resort to the building or <br />structure for committing a nuisance or an unlawful act. <br />Conclusions of Law Based on Above Findines: <br />1. By allowing the structure to remain damaged and unsecured so as to become an <br />attractive nuisance to children who might play in the building or structure to their <br />danger, to become a harbor for vagrants, criminals, or immoral persons, the <br />Respondent violated IPMC 108.1.5(7). <br />ORDER <br />Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br />determined that the Respondent is in default and was in violation of IPMC 108.1.5(7) <br />and is hereby ordered to: <br />1. The City abated all violations of IPMC 108.1.5(7) on property located at 1215 <br />Everett Avenue, Everett, Washington. <br />2. The Respondent shall maintain the vacant structure on site from trespass and <br />occupancy until occupancy is approved by the City of Everett Building Division. <br />3. The Respondent shall apply for and obtain all required City of Everett permits to <br />bring the structure into compliance. <br />
