City if the City needs to clean up. A $1,000 deposit will be charged in advance of the Block <br /> Party. This $1,000 will be refunded in full if no City cleanup is needed. Should the City need <br /> to clean up after the event, the City shall retain that portion of the $1,000 which covers the <br /> City's cleanup expenses. <br /> 5. DEBA shall repair any damage to asphalt; protect buildings and landscape from damage; pay <br /> for the cost to sweep the parking lot and streets surrounding area; provide unobstructed <br /> access to the fire suppression system at the Wall Street Building and, if there is any damage, <br /> agrees to reimburse the City for any repairs necessitated as a result of the Block Party. <br /> 6. DEBA will pay to the City of Everett a non-refundable rental fee of$500. <br /> 7. DEBA shall submit a written site plan to the City no less than two weeks prior to the Block <br /> Party. <br /> 8. DEBA agrees to submit a written plan acceptable to the Police Department for operation of <br /> the Beer Garden no less than two weeks prior to the event. This plan shall include, at a <br /> minimum, a system for age identification of customers, a system for the purchase of liquor by <br /> customers, the control of consumption of liquor, entry and perimeter security, and staffing <br /> levels. <br /> 9. Per Snohomish Health District requirements, DEBA shall submit a Coordinator's Checklist to <br /> the Health District at least twenty-one days before the event, and provide adequate restroom <br /> facilities, garbage disposal and food booth facilities as required by the Health District. <br /> 10. DEBA agrees to save the City, its officers, employees and agents harmless and indemnify <br /> them from all loss, claims or damage occasioned to the City, its officers, employees or agents <br /> or to any third person or property by reason of any act or omission of DEBA, its employees <br /> or agents which arises as a result of this event, and shall, after reasonable notice thereof, <br /> defend and pay the expense of defending any suit which may be commenced against the City, <br /> its officers, employees or agents, or any third person alleging injuries by reason of such acts or <br /> omissions and will pay any judgments which may be obtained against the City, its officers, <br /> employees, agents or third persons in such suit. <br /> 11. DEBA agrees to request closure of Wetmore Avenue from Hewitt to Wall for this event. <br /> 12. DEBA agrees to enter into a written agreement with the City which includes the above <br /> conditions. <br /> Councilperson Introducing Resolution <br /> PASSED and APPROVED this 26th day of June , 1996. <br /> Council President. <br />
