;i <br /> 1 <br /> i <br /> April 10, 1998 � <br /> Port o f Everett <br /> Mr. Dick Eitel <br /> FISHERMEN's BOATSHOP <br /> 1016 — 14'� Street <br /> Everett, WA 98201 <br /> Re: Stormwater Agreement. <br /> Deaz Dick: <br /> The purpose of this letter is to establish a firri understanding regarding FBS's desire to <br /> discharge stormwater direccly into the City of Everett's sanitary lino. FBS needs this <br /> access in order to fulfill other permit requirements vis a vis the Departmeat of Ecology. <br /> In order to obtain a �tormwater discharge permit from the City, FBS has two alternatives. <br /> Under the first scenario FBS would be permitted to discharge directly into the City's line <br /> provided discharg;, would be limited to periods of non-peak stormwater flow. FBS would <br /> be classified as a secondary user. The Port's discharge limit wou(d not be curtailed <br /> because FBS would be required to install :elemetry controls in the existing lift station to <br /> shut down their discharge before the system reached full capacity as well as installation <br /> of on site containment. <br /> The second scenario would afford FBS an opportunity to initially avoid capital expense <br /> of installing telemetry controls and containment. This would be done by taking advantage <br /> of the Port's dischazge limit from the South Marina. The Port's curcent discharge limit is <br /> 2.4cfs. As it goes, the maximum discharge from the South Marina is limited to 2.19cfs by <br /> the size of the orifice at the connection point, as calculated by Reid Middleton. This <br /> leaves unused capacity of 0.21cfs that FBS now seeks to "borrow" from the Port, <br /> a(lowing FBS a direct connection without installing telemetry controls or containment <br /> until such time as the Port may need this discharge volume to support other development. <br /> If, in the fuhire, the Port needed the balance of the a(luwable stortnwater discharge for its <br /> own purposes, FBS would be required to either install the necessary equipment or else <br /> return the"borrowed" capacity to the Port. <br /> However, the Port would be willing to loan FBS the excess capacity as long as the <br /> following two conditions are agreed. First, both parties agree the Port's accommodation <br /> to FBS is a loan and not an irrevocable canveyance of stormwater discharge rights the <br /> Port now owns. That means the Port can take the stormwater discharge capacity back <br /> whenever the Port needs to use it. However, the Port will notify FBS of such action as far <br /> in advance as practical. As further consideration, FBS agrees to permanertly modify its <br /> docking procedures at your float adjacent to the marine railway. That is, FBS will be <br /> limited �0 33feet maximum width for vessels moored on the North side of your work float <br /> in the restricted area.
