In this case, exceptions <br /> will be ganted by the Port's Marina Operations Manager as long as the following <br /> conditions are met: <br /> 1.) FBS provides the Marina Opeiations Manager at least three days notice. <br /> 2.) Vesce! moorage over 33ft abeam is lim�ted to one (:j 24h� period unless prior <br /> autl iorization has been obtained from Marina Cperations Manager. <br /> 3.) No barge or vessel moored on the North side of FBS work float will extend out into <br /> the Mazina beyond the end of the float for more than twelve (]2) hours unless <br /> specifically authorized by the Marina office. <br /> 4.) In ihe case where the haul out navigation channel will be reduced to less than 27ft <br /> FBS agrees to reposition any vessels moored at M-North on the Marina side to <br /> another temporacy berth, at your own time and expense, until such time as the channel <br /> is returned to its full operational width. <br /> 5.) FBS aErees to obtain permission to move the encumbering vessel at M-North from <br /> the vessel ownec currently Everett Bayside Marine. <br /> The Port reserves the right to discontinue the stormwater :oan to FBS at any time, and at <br /> the Port's sole discretion. By our agePment to specify the minimum dimensions of the <br /> Port's navigation channel, as well as FBS's docking procedures, we are not suggesting <br /> that FBS's past practices have always been consistent with the Iease provisions <br /> concerning access rights.
