Hatch Act. No funds may be used for working for or against ballot r• measures or for or against the candidacy of any person for public office. Contractor employees and officers being paid with funds from this contract, except public officials serving on the governing and/or advisory board in compliance with federal board composition requirements, may not run for an elected partisan office. This restriction does not prohibit an employee or officer from being a candidate for/or occupying a non- partisan office, from participating in political management and campaigns, including running for and serving as an officer within the political party structure, or participating in partisan politics during non-work time. The Contractor shall certify that no funds payable under this Agreement will be paid by or on behalf of the Contractor to pay any person for influencing or attempting to influence an officer or employee of any agency, Member of Congress, an officer or employee of Congress, or any employee of Member of Congress in connection with the awarding of any federal or state Contract, grant, loan or cooperative agreement. 6.14 Conflict of Interest and Kickbacks. Employees, subcontractors, and board or committee members shall not use, or give the appearance of using, their positions for the personal gain of themselves or those with whom they have family, business or other ties. Employees, subcontractors and board or committee members shall not have or acquire any interest, direct or indirect, which would conflict with the performance of services under this Agreement. The Contractor shall not employ or subcontract with persons who have conflicts of interest, nor appoint them as members of its governing board or advisory committee. Personnel, and governing board, or advisory committee policies of the Contractor, shall include written standards of conduct governing conflict of interests and kickbacks. Gratuities in the form of entertainment, gifts or otherwise offered by the Contractor, an agent or representative of the Contractor to any officer or employee of the City or to any officer or employee of DCTED, with a view towards securing this Agreement or securing favorable treatment with respect to the awarding, amending or the making of any determination shall render this Agreement voidable at the option of City or DCTED and may justify further action under the Executive Conflict of Interest Act, Title 42.52 RCW. Contractor is prohibited from including, by any means, people employed under this Agreement or a subcontract to give up any part of the compensation to which it is otherwise entitled.
