1 4 <br /> Section 1. Section 3(D) of Chapter 5 of said Ordinance No. 2530-01 (EMC <br /> 15.20.110), which reads as follows: <br /> Time limit for Review Process II and III permits. <br /> If a complete application has not been filed for a building permit or equivalent <br /> construction permit within eighteen months on a project for which a land use permit has <br /> been granted under Review Process II or III, and an extension has not been granted: <br /> A. The land use permit shall be deemed to be terminated, except where a time limit on <br /> the land use permit is otherwise established by federal or state law, city ordinance, or an <br /> executed development agreement. <br /> B. If the permittee requests an extension in writing not later than eighteen months from <br /> the land use permit date, the director may grant a six-month extension. <br /> For any reapplication, the city may use the existing SEPA determination or may require <br /> new or additional environmental documents as provided by WAC 197-11-600. <br /> Is hereby amended to read as follows: <br /> Time limit for Review Process II and III permits. <br /> If a complete application has not been filed for a building permit or equivalent <br /> construction permit within eighteen twenty-four months on a project for which a land use <br /> permit lias been granted under Review Process II or III, and an extension has not been <br /> granted: <br /> A. Severability. Should any section, paragraph, clause or phrase of this <br /> Ordinance, or its application to any person or circumstance, be declared unconstitutional <br /> or otherwise invalid for any reason, or should any portion of this Ordinance be pre- <br /> empted by state or federal law or regulations, this shall not affect the validity of the <br /> remaining portions of this Ordinance or its application to other persons or circumstances. <br /> 61 <br />
