ORDINANCE NO. 3443-15 <br />An Ordinance establishing land use regulations for recreational <br />marijuana businesses, amending Ordinance No. 1671-89, as amended <br />(EMC Title 19, Zoning), and superseding Ordinance No. 3407-14, as <br />amended <br />Whereas, the City Council finds that: <br />1. Initiative Measure No. 502, approved on November 6, 2012, modified the State Controlled <br />Substances Act to allow the possession of marijuana for private, personal use and established <br />a system for lawful production, processing, and retailing of recreational marijuana under state <br />law; and <br />2. Initiative Measure No. 502 and the Washington State Liquor and Cannabis Board (WSLCB) <br />rules adopted thereunder established licenses for producers, processors, and retailers of <br />recreational marijuana (collectively "marijuana businesses"); and <br />3. The City has had, at all relevant times, interim zoning regulations (Ordinance No. 3407-14, <br />as amended) such that applicants have had clear notice of local zoning requirements; and <br />4. There have been three marijuana retailers established in the City, and the City is aware of <br />two other potential retailers that have been initially identified by the WSLCB, subject to <br />further review and approval by the WSLCB and the City; and <br />5. The City's interim regulations allow only Tier 1 production and / or processing facilities, <br />while the larger Tier 2 and Tier 3 facilities are not permitted; and <br />6. There have been no production / processing facilities established in the City; and <br />7. The City desires to adopt permanent regulations as provided herein, removing the interim <br />designation from the regulations; and <br />8. The City's interests are best served by adopting permanent regulations at this time, even <br />though the City will continue to monitor impacts and additional information related to this <br />new industry in Everett and elsewhere in the State, and will make additional changes as may <br />be determined by the City to be in its best interests; and <br />Page 1 of 7 <br />
