9. A State Environmental Policy Act, RCW 43.21 C, Final Determination of Non Significance <br />(SEPA #15-015) for the regulation of marijuana businesses was issued on March 23, 2015; <br />and <br />10. The Planning Commission held three public workshops in February, March and April, 2015, <br />and held a public hearing on May 19, 2015, making recommendations to the City Council <br />regarding the permanent regulations for recreational marijuana; and <br />11. The City Council held a public briefing and held a public hearing on the date of adoption of <br />this Ordinance; and <br />Whereas, the City Council concludes that: <br />1. Nothing in this Ordinance is intended to encourage any use or activity that violates federal <br />law; and <br />2. It is prudent to continue to take a conservative approach to land use regulations related to <br />recreational marijuana production and processing uses until there is more evidence <br />concerning the community impacts from such uses in Everett and elsewhere in Washington; <br />and <br />3. The City Council wishes to protect Everett's industrial land supply for targeted industries, <br />including aerospace, biomedical, technology, and other manufacturing and industrial uses <br />that provide family wage jobs; and <br />4. The proposed amendments are consistent with the applicable policies of the Everett Growth <br />Management Comprehensive Plan; and <br />5. The proposed amendments promote the best long term interests of the Everett community. <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1. Findings of Fact <br />The "Whereas" provisions above shall constitute Findings of Fact and are incorporated by <br />reference as if fully set forth herein <br />Section 2. Ordinance No. 1671-89, as amended (EMC Title 19, Zoning), is hereby amended <br />by the addition of the following, which shall be codified as EMC 19.39.145: <br />Page 2 of 7 <br />
