. /. • <br /> f <br /> CONTRACTOR <br /> 13mo-"94,1414°1-j7 Date: L5/51/06/, <br /> y <br /> Officer <br /> Exhibit A Description of Changed Work <br /> This change order#1 ads one new bid item to the contract as described below. <br /> Work Order UP 2770 <br /> Create new bid item#13 entitled, "Groundwater Dewatering Dispute Resolution <br /> Payment", in the agreed lump sum amount of$55,000.00. This lump sum agreed <br /> payment is being made to resolve all costs,what so ever,relative to the groundwater <br /> dewatering dispute between City of Everett and Clearcreek Contractors Payment in the <br /> amount of$55,000.00 will be made,less 5% retainage($2,750.00) and plus the addition <br /> of sales tax @ 9.2% ($5,060.00). (The contract had an underrun or$31,693 to which staff <br /> wishes to add$23,307,plus tax,in order to fund the$55,000 settlement.) <br /> Once this change order#1 is approved by City of Everett Council, allowing the Mayor to <br /> sign it,a.check in the amount of$57,310.00, ($55,000.00-$2,750.00+$5,060.00)willbe <br /> prepared and sent to Clearcreek Contractors. The City of Everett will forward Clearcreek <br /> Contractors a final estimate and two copies of the final contract voucher for execution. <br /> Once Clearcreek Contractors' signs and returns both copies of the final contract voucher, <br /> the project will be presented to City of Everett Council for final acceptance. Upon <br /> approval by City Council accepting the project as complete, a Certificate of Completion <br /> will be signed by the Mayor and forwarded to Clearcreek Contractors. <br /> The 5%retainage being withheld,($14,580.34), will be released following 60 days after <br /> City of Everett Councilhas accepted the project as complete, and provided City Clerk has <br /> received releases from the Department of Revenue and Employment Security and there <br /> are no liens on the project. <br /> JUSTIFICATION: <br /> To prevent an even more costly claim dispute between City of Everett and Clearcreek <br /> Contractors. <br /> CONTRACT TIME: Change order#1 ads 5.4 additional calendar days to the contract <br /> duration. The contract allowed 30 calendar days for physical completion of the contract <br /> work. Notice to proceed was issued on July 18,2008 and physical completion was <br /> granted on October 9,2008. <br /> 22 <br />
