V <br />d. termination of this Memorandum and the trial program is <br />in the best interests of the City. <br />6. LCA at its sole discretion may terminate this Memorandum and <br />the trial program effective on written notice to the City. <br />7. Modifications to this Memorandum are only. effective if in <br />writing and signed by Mayor on behalf of the City. The City may <br />unilaterally modify this Memorandum effective on delivery of the written <br />modification to LCA. <br />8. The notice address and contact person for each party is listed <br />below: <br />a. City Notice Address: City of Everett Parks and <br />Recreation Department, 802 E. Mukilteo Blvd. <br />Everett, WA 98203. <br />City Contact Person: John Petersen, Assistant Director <br />for Planning and Maintenance (425-257-8371). <br />b. LCA Notice Address: 2216 Main Street, Everett WA <br />98203. <br />LCA Contact Person: Megan Dunn (425- 252-6265). <br />For a notice under this Memorandum to be valid, it must be in writing and <br />the sending party must deliver the notice to receiving party's address listed <br />above. <br />9. If a dispute arises regarding this Memorandum or regarding the <br />trial program, the contact persons listed above should meet in person to <br />resolve the issue. Those persons should seek assistance from the Office of <br />Neighborhoods and then the Mayor's Office, if necessary. <br />10. LCA will comply with all applicable laws regarding the <br />Property and its use of the Property. <br />11. This Memorandum is not a binding contract. The parties do not <br />confer any rights on third parties by this Memorandum. <br />4 <br />15 <br />
