9 <br />2. The City will do the following related to the trial program: <br />a. Provide direction, assistance, and guidelines on LCA <br />work within the pesticide -free area at Lowell Park. <br />b. Provide loan of and storage of hand tools and implements <br />to assist the LCA. volunteers in their weed control tasks. <br />C. Provide routine disposal of weeds and materials collected <br />by LCA volunteers within the scope of the trial program. <br />3. The City and LCA will jointly: <br />a. perform periodic site walks (monthly during growing <br />season; 1-2 times outside of growing season) for <br />assessment of Lowell Park to determine maintenance <br />needs; and <br />b. develop a work plan to address identified needs. <br />4. The City will not apply any pesticides in Lowell Park during <br />the trial program period unless the City determines in its sole discretion that <br />pesticide application is necessary to meet health and safety standards, that <br />pesticide applications are required by other governmental agencies to control <br />an invasive pest or a public health threat, or that pesticide application is in <br />the best interests of the City. If the City determines that a pesticide <br />application is needed, the City will apply the pesticide using standard <br />Integrated Pest Management procedures, which include providing, notice of <br />the application in the location where the pesticide is applied. <br />5. The City at its sole discretion may terminate this Memorandum <br />and the trial program effective on written notice to LCA if the City <br />determines that: <br />a. LCA has failed to meet its obligations under this <br />Memorandum; <br />b. the trial program is no longer consistent with City <br />policies; <br />C. the City is unable to resolve a dispute with LCA; or <br />3 <br />14 <br />
