2 <br /> Exhibit 12 Exhibit List dated April 16, 2015 <br /> Based upon a review of the administrative hearing record, the following Findings of Fact <br /> and Conclusions of Law hereby constitute the basis of the decision of the Everett <br /> Violations Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. Amanuel Debesay and Azieb Tsegay, Respondents, are the owners of record of the <br /> property at 2301 California Street, Everett, Washington (property). The property is <br /> in an R-4, Multiple Family High Density zone as established by the City of Everett. <br /> (Exhibit#10, Snohomish County Assessors Record dated April 8, 2015) (Exhibit <br /> #11, Go Sync Maps) <br /> 2. On February 3, 2015, City of Everett Code Enforcement (ECE) Officer Don <br /> Cunningham inspected the property and observed and photographed that eight <br /> vehicles were parked in the back and side yards of the property in public view and <br /> bagged garbage had been discarded in the backyard. While on site ECE Officer <br /> Cunningham was informed by a tenant of the attached accessory structure that he <br /> lived in the structure without water service, a bathroom and windows. ECE Officer <br /> Cunningham was told that the residential structure on site was occupied by two <br /> tenants on the main floor and two tenants in the basement. (Exhibit#2y-2gg, <br /> Inspection Photos dated February 3, 2015 with Washington State Vehicle License) <br /> (Testimony of Code Enforcement Officer Cunningham) <br /> 3, On February 18, 2015, ECE Officer Cunningham reinspected the property and <br /> observed and photographed that the discarded bagged garbage had been removed <br /> from the backyard. (Exhibit#2w-2x, Inspection Photos dated February 18, 2015) <br /> (Testimony of Code Enforcement Officer Cunningham) <br /> 4. On March 2, 2015, ECE Officer Cunningham contacted Respondent Debesay and <br /> was informed that the tenant of the attached accessory structure would be moving <br /> out and that four individuals lived in the residential structure on site. Respondent <br /> Debesay agreed to meet with ECE Officer Cunningham for an inspection of the <br /> structures on the property. (Testimony of Code Enforcement Officer Cunningham) <br /> 5. On March 9, 2015, ECE Officer Cunningham, Ted Budden, City of Everett Building <br /> Division Inspector and Respondent Debesay conducted an inspection of the <br /> property. During the inspection of the residential structure on site, Inspector <br /> Budden and ECE Officer Cunningham observed and photographed the following: <br /> a. The occupied basement area of the residential structure on the property had <br /> been altered to include a bathroom, kitchen area and bedroom. <br /> b. The ceiling height of the basement was less than the required 84 inches per <br /> code. <br /> c. A gas fired furnace and hot water heater had been installed next to the <br /> bedroom. <br /> �-I 0 <br />
