XI. FINDINGS RELATING TO THE COMPLIANCE WITH THE PROVISIONS OF THE SPU ORDINANCE AND OTHER CITY, STATE, AND FEDERAL REGULATIONS 41. The Applicant must develop the property and the structure on the property consistent with the Building and Fire Codes of the City of Everett. In addition, the conditions of the MDNS must be satisfied. The Applicant will satisfy all City, State, and Federal regulations in development of the site. XII. FINDINGS RELATING TO PUBLIC TRANSIT AND TRAFFIC REDUCTION MEASURES PROPOSED BY THE APPLICANT 42. The facility will not generate significant amounts of traffic. The residents of the facility will not have vehicles, and the only traffic generated by the site will be for the staff and visitors. The City indicated that upon review it does not anticipate more than an average of 20 vehicular trips per day. There is adequate parking on-site to satisfy the parking of these vehicles. 43. The facility is near the Everett Transit Route #20, and there is a bus stop at 40th Street and Smith Avenue. This site is accessible to public transit. There will not be impacts to the public transit or to traffic congestion as a result of this proposal. XIII. FINDINGS RELATING TO PUBLIC TESTIMONY At the hearing, testimony was received from the public. Included was testimony presented by witness Terry Slatten. As noted in the list of exhibits of this document, Mr. Slatten submitted a large number of documents relating to this project (see exhibit#191 attached for the complete list of documents submitted by Slatten). The following findings relate to Mr. Slatten's testimony and to the exhibits submitted. 44. Mr. Slatten submitted his exhibits to support opposition to the issuance of the Special Property Use Permit request by the Applicant. The exhibits were detailed and cover a wide range of subjects.
