XI. <br /> FINDINGS RELATING TO THE COMPLIANCE WITH THE PROVISIONS OF THE SPU <br /> ORDINANCE AND OTHER CITY, STATE, AND FEDERAL REGULATIONS <br /> 41. The Applicant must develop the property and the structure on the property <br /> consistent with the Building and Fire Codes of the City of Everett. In addition, <br /> the conditions of the MDNS must be satisfied. The Applicant will satisfy all City, <br /> State, and Federal regulations in development of the site. <br /> XII. <br /> FINDINGS RELATING TO PUBLIC TRANSIT AND TRAFFIC REDUCTION <br /> MEASURES PROPOSED BY THE APPLICANT <br /> 42. The facility will not generate significant amounts of traffic. The residents of the <br /> facility will not have vehicles, and the only traffic generated by the site will be for <br /> the staff and visitors. The City indicated that upon review it does not anticipate <br /> more than an average of 20 vehicular trips per day. There is adequate parking <br /> on-site to satisfy the parking of these vehicles. <br /> 43. The facility is near the Everett Transit Route #20, and there is a bus stop at 40th <br /> Street and Smith Avenue. This site is accessible to public transit. There will not <br /> be impacts to the public transit or to traffic congestion as a result of this <br /> proposal. <br /> XIII. <br /> FINDINGS RELATING TO PUBLIC TESTIMONY <br /> At the hearing, testimony was received from the public. Included was testimony <br /> presented by witness Terry Slatten. As noted in the list of exhibits of this document, Mr. <br /> Slatten submitted a large number of documents relating to this project (see exhibit#191 <br /> attached for the complete list of documents submitted by Slatten). The following <br /> findings relate to Mr. Slatten's testimony and to the exhibits submitted. <br /> 44. Mr. Slatten submitted his exhibits to support opposition to the issuance of the <br /> Special Property Use Permit request by the Applicant. The exhibits were <br /> detailed and cover a wide range of subjects. Listed below are how these <br /> exhibits have been interpreted by the Hearing Examiner with regard to relevancy <br /> of the issues presented at the hearing: <br /> 13 <br />
