CITY OF EVERETT PUBLIC WORKS <br /> SPECIAL PROVISIONS <br /> SECTION 012513 —PRODUCT SUBSTITUTION PROCEDURES <br /> PART 1 —GENERAL <br /> 1.1 SECTION INCLUDES <br /> A. Procedure for the consideration of substitutions for specified products. <br /> 1.2 RELATED SECTIONS <br /> A. Section 01 33 00 - Submittal Procedures <br /> 1.3 SUBMITTALS <br /> A. Substitution requests: Submit five hard copies and one electronic copy. Use the form provided <br /> at end of this section. Attach submittals required for specified product. <br /> 1.4 SPECIFIED CONDITIONS <br /> A. Substitutions may be considered at the Owner's discretion under the following conditions: <br /> 1. Specification by Referenced Standard: If standard specified is obsolete, or has been <br /> superseded as of Bid Invitation Date, submit Substitution Request including current <br /> applicable standard and product information showing compliance therewith. <br /> 2. Specification by manufacturer name and product. Substitution will be considered if <br /> request complies with requirements of this section. <br /> 3. Specification by manufacturer and product followed by: "Substitution not permitted", <br /> "No Substitution," or other similar phrase. Use only specified product. <br /> 1.5 LIMITATIONS ON SUBSTITUTIONS <br /> A. Timely request: Substitution requests will be considered only if submitted 15 days or more <br /> before date scheduled for ordering material proposed for substitution. <br /> B. Informal requests: Substitutions will not be considered if: <br /> 1. Submitted without attached form, properly executed. <br /> 2. Submitted directly from subcontractor or supplier. <br /> 3. Acceptance will require substantial revisions to Contract Documents. <br /> C. Approval of any substitution or product option does not relieve the Contractor of the <br /> responsibility of ensuring the proper fit, access to equipment, and proper mounting of the <br /> various parts of the Work. <br /> D. Exceptions: After Contract date, the Owner may, at his option, consider certain other <br /> substitutions from the General Contractor submitted in accordance with requirements of this <br /> section.
