Global Project Assumptions <br /> Throughout the course of this project, the following guidelines are applicable: <br /> Assumptions and Constraints <br /> • The deliverables and breakdown of efforts within this document limit the scope of <br /> consulting services. <br /> • All service deliveries take place during normal business hours Monday through Friday <br /> 7:00 AM PST to 6:00 PM PST unless otherwise specified or agreed during Discovery <br /> and Design, or the pre-install meetings. <br /> • City of Everett's network is in good working order and is not architected in a way that <br /> would impede the scope of this project <br /> Out of Scope <br /> • Upgrades to the operating system of Commvault server components <br /> • Any services, tasks or activities other than those specifically noted in this SOW <br /> • Implementation of product features not intended for deployment <br /> • Hardware or software upgrades to components outside of the scope of this project <br /> • Support or replacement of product: <br /> o Altered, modified, mishandled, destroyed or damaged by natural causes <br /> o Altered, modified, mishandled, destroyed or damaged due to a negligent or willful act <br /> or omission by City of Everett or a third party <br /> o Used by City of Everett or a third party other than as specified in the applicable <br /> Sysorex USA-supplied or product vendor documentation <br /> • Services to resolve software or hardware problems resulting from third party equipment, <br /> services, or problems beyond the control of Sysorex USA (this includes software defect <br /> troubleshooting) <br /> • Services to resolve software or hardware problems resulting from undisclosed pre- <br /> existing configurations not included in Discovery and Design discussions <br /> City of Everett Responsibilities <br /> Performance by Sysorex USA is dependent upon City of Everett management and fulfillment of <br /> assigned responsibilities, at no charge to Sysorex USA. Any delay in performance of City of <br /> Everett Responsibilities may result in additional charges and/or delay of the completion of the <br /> Services.
