5 INTERLOCAL AGREEMENT REGARDING CONSTRUCTION OF SWIFT BRT <br /> STATIONS <br /> This Interlocal Agreement Regarding Construction of Swift BRT Stations (this <br /> "Agreement")is entered into by and between the Snohomish County Public <br /> Transportation Benefit Area Corporation("Community Transit") and the City of Everett <br /> ("Everett Transit") as of October , 2009. <br /> RECITALS <br /> A. Community Transit and Everett Transit are parties to the Interlocal <br /> Agreement Regarding the Cooperative Provision of Services dated December 5, 2007 <br /> (the"2007 Interlocal Agreement"). The 2007 Interlocal Agreement concerns bus rapid <br /> transit (`BRT"). The 2007 Interlocal Agreement included provisions regarding the <br /> construction of BRT stations in the Highway 99, Evergreen Way, Rucker Avenue, and <br /> Pacific Avenue corridor(the"Swift Corridor"). <br /> B. In accordance with the 2007 Interlocal Agreement, Everett Transit has <br /> made four million dollars ($4,000,000) in capital contributions for Community Transit to <br /> build BRT stations in the Swift Corridor. Community Transit has begun this project. <br /> However, additional money is needed to build all of the BRT stations planned for the <br /> Swift Corridor. <br /> C. In 2009, Everett Transit received from the Washington State Department <br /> of Transportation("WSDOT') one million six hundred thousand dollars($1,600,000) for <br /> BRT stations (the"WSDOT Grant"). As a condition for receiving the WSDOT Grant, <br /> Everett Transit will also contribute about four hundred sixty-two thousand dollars <br /> ($462,000) for BRT stations(the"Everett Local Match"). <br /> D. Community Transit and Everett Transit intend to use the WSDOT Grant <br /> and the Everett Local Match to develop and construct four more of the planned BRT <br /> Stations in the Swift Corridor: <br /> • a northbound station and a southbound station located on Evergreen Way <br /> between 50th Street SW and Casino Road in Everett; and <br /> • a northbound station and a southbound station located at approximately <br /> Evergreen Way and 112th Street SW in Everett. <br /> These four stations are collectively referred to in this Agreement as the "WSDOT <br /> Stations." <br /> E. Community Transit and Everett Transit desire to enter into this Agreement <br /> to provide for the administration of the WSDOT Grant and the Everett Local Match and <br /> for the management of the development and construction of the WSDOT Stations. <br /> 16 <br />
