„\EVEIEETT <br /> RESOLUTION NO. 4047 <br /> A RESOLUTION establishing rules and regulations governing the <br /> applications for and granting of variances from the City's noise <br /> control regulations. <br /> Whereas, the City of Everett has established noise control regulations through the <br /> adoption of Chapter 20.08 EMC; and <br /> Whereas, EMC 20.08.150 authorizes the Noise Control Administrator to grant <br /> variances to the City's noise regulations pursuant to rules promulgated by the City <br /> Council; and <br /> Whereas, there is a need to establish such rules; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT THAT: <br /> Section 1: Pursuant to EMC 20.08.150, the City Council does hereby promulgate rules <br /> and regulations for the application for and granting of variances from the City's noise <br /> control regulations, including hearings and notice. <br /> Section 2: Applications for a noise variance shall be submitted to the City's Noise <br /> Administrator on forms provided by the Administrator and shall be accompanied by a <br /> fee in the amount of One Hundred Dollars ($100). Any person who owns or is in <br /> possession of any property or use, or any process or equipment not in compliance with <br /> the provisions of Chapter 20.08 EMC, may make a request for a variance to the <br /> Administrator for relief from any provision of Chapter 20.08 EMC governing the quality, <br /> nature, duration or extent of discharge of noise. <br /> The Applicant must submit with the application a list of all property owners who adjoin <br /> the subject property per County Assessor records unless: (1) The Administrator <br /> determines that the granting of a variance would have no significant impact on <br /> adjoining property owners in which case no list shall be required; or (2) The <br /> Administrator determines that the granting of the variance would have a significant <br /> impact on property owners in addition to the adjoining property owners, then the <br /> Applicant shall submit a list per County Assessor records of all property owners within <br /> five hundred feet (500') of the subject property or such other distance as the <br /> Administrator determines appropriate to include impacted property owners. <br />
