Section 3: In order to grant a variance, the Administrator must consider the relative <br /> interests of the Applicant, other owners or possessors of property likely to be affected <br /> by the noise and the general public. The Administrator shall apply the criteria set forth <br /> in EMC 20.08.180 A & B in determining whether or not to grant the variance. The <br /> Applicant must comply with all of said criteria in order for a variance to be granted. In <br /> the event the Administrator grants the variance, notice shall be mailed by first class <br /> mail to those property owners appearing on the list provided the Administrator per <br /> Section 2 of this Resolution. The Applicant shall be responsible for paying all mailing <br /> costs which shall be in addition to the application fee in Section 2. <br /> Section 4: Any variance granted by the Administrator shall be restricted in duration <br /> and an implementation schedule for achieving compliance with Chapter 20.08 EMC <br /> shall be incorporated into any variance granted. <br /> Section 5: No variance shall exceed one year. Variances granted may be renewed. <br /> But no renewal shall be granted unless an application is made at least sixty (60) days <br /> prior to the expiration of the variance. The Administrator may promulgate rules for <br /> renewing variances. <br /> Section 6: Any person aggrieved by the denial, grant or terms and conditions on the <br /> grant of an application or renewal of a variance by the Administrator may appeal such <br /> decision by filing a written appeal with the City's Hearing Examiner in accordance with <br /> the procedures in EMC 20.08.160 and 20.08.170. The filing of an appeal shall remain <br /> the implementation of the Administrator's decision pending a final decision on the <br /> appeal.
