,e1117-A <br /> EL 4ETT <br /> RESOLUTION NO. 3962 <br /> RESOLUTION OF INTENT TO REZONE AND PERFORMANCE AGREEMENT <br /> TERRY LINDBLOM <br /> Meridian II Rezone <br /> WHEREAS, Terry Lindblom filed an application to rezone property located at 10315 <br /> Meridian Avenue for the purpose of creating a residential subdivision of four lots; and <br /> WHEREAS, the Hearing Examiner, after holding a public hearing, did adopt certain <br /> Findings and Conclusions and did recommend to the Everett City Council that the proposed <br /> rezone be approved pursuant to the provisions of Section 41.160.D.7 of Ordinance 1671-89 as <br /> amended, and shall be subject to the specific conditions set forth herein; and <br /> WHEREAS, the City of Everett finds that by approving a change in zoning of the subject <br /> property from R-S, Suburban Residential, to R-1, Single-Family Low Density, and by <br /> establishing certain procedures to evaluate future site development, the proposal is compatible <br /> with abutting properties as proposed; and <br /> WHEREAS, the Everett Zoning Code provides a mechanism by which the City and property <br /> owner may enter into a "performance agreement" wherein the proponent of a rezone agrees to <br /> develop property according to the terms of the agreement before the rezone is finalized by <br /> City. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Everett <br /> declares its intent to rezone property located at 10315 Meridian Avenue as described in the <br /> attached legal description, from R-S, Suburban Residential, to R-1, Single-Family Low <br /> Density, for the purpose of subdividing the lots, pursuant to the provisions of Section 41.160 <br /> of Ordinance 1.671-89, as amended, and the conditions of this Resolution of Intent. Council <br /> shall, by ordinance, effect such rezone upon being advised that all of the following conditions <br /> and requirements contained in this Resolution have been met: <br /> 1. It appears that the amount of pavement to be created by this project will be less than <br /> 10,000 square feet and water quality enhancement of stormwater runoff will not <br /> technically be required. However, a Hydraulics Project Approval (HPA) from the <br /> State Department of Fisheries or Wildlife may be required for this project. The State <br /> may have more stringent detention and water treatment requirements than the City <br /> would impose. If a stormwater treatment system is required by an HPA, it must meet <br /> all applicable City standards, including type of facility. In that case, a wetpond would <br /> probably be required. <br /> 1 <br />
