vati1L JFETT <br /> RESOLUTION NO. 3958 <br /> RESOLUTION OF INTENT TO REZONE AND PERFORMANCE AGREEMENT <br /> GORDON REYKDAL <br /> 1814 - 105th Street S.E. <br /> WHEREAS, Gordon Reykdal filed an application to rezone property located at 1814 - 105th <br /> Street S.E. for the purpose of establishing a business use; and <br /> WHEREAS, the Hearing Examiner, after holding a public hearing, did adopt certain <br /> Findings and Conclusions and did recommend to the Everett City Council that the proposed <br /> rezone be approved pursuant to the provisions of Section 41.1.60.D.7 of Ordinance 1671-89 as <br /> amended, and shall be subject to the specific conditions set forth herein; and <br /> WHEREAS, the City of Everett finds that by approving a change of use of the subject <br /> property from a single-family residence to a business use and by establishing certain <br /> procedures to evaluate future site development, the proposal is compatible with abutting <br /> properties as proposed; and <br /> WHEREAS, the Everett Zoning Code provides a mechanism by which the City and property <br /> owner may enter into a "performance agreement" wherein the proponent of a rezone agrees to <br /> develop property according to the terms of the agreement before the rezone is finalized by <br /> City. <br /> NOW, THEREFORE, BE IT RESOLVED that the Everett City Council of the City of <br /> Everett declares its intent to rezone property located at 1814 - 105th Street S.E. as described in <br /> the attached legal description, from R-1, Single-Family Residential, to B-2(B), Office, for the <br /> purpose of changing the use of the property from residential to a business use, pursuant to the <br /> provisions of Section 41.160 of Ordinance 1671-89, as amended, and the conditions of this <br /> Resolution of Intent. Council shall, by ordinance, effect such rezone upon being advised that <br /> all of the following conditions and requirements contained in this Resolution have been met: <br /> 1. Prior to amendment of the City of Everett Zoning Map, the existing residential use <br /> must be discontinued, and another use, which is a permitted use in the B-2(B) zone, <br /> must be established on the site. <br /> 2. Conversion of the site to a permitted use in the B-2(B) zone will be subject to all City <br /> codes and ordinances, including the Zoning Code, SEPA, drainage requirements, and <br /> city construction standards. A use permit will be required for any change of use of the <br /> existing residence. <br /> 1 <br />
