3. Any change of use on the site will be subject to review under the City's <br /> environmentally sensitive area regulations. The City may require wetland buffer <br /> restoration and enhancement, depending on the impacts to sensitive areas and their <br /> buffers. <br /> 4. There is a possibility that the zoning of the subject property will be changed by the City <br /> prior to the site being converted to a commercial use. This could occur as a result of <br /> the City's current effort to adopt a new Comprehensive Plan and Zoning Map. If the <br /> zoning is changed by the City, prior to conversion of the site to a permitted use in the <br /> B-2(B) zone, then this Resolution of Intent to Rezone shall become void. <br /> TIME LIMITS - Within a period of three years following the adoption of this Resolution of <br /> Intent to Rezone by City Council, the applicant shall make any necessary improvements to <br /> establish a use on the site consistent with the B-2(B) zoning standards. <br /> If the applicant fails to comply with the time limits specified herein, the Resolution of Intent to <br /> Rezone shall be void. All future permits shall be subject to the requirements of the R-1, <br /> Single-Family Residential zone. <br /> PERFORMANCE AGREEMENT REZONES - MAP CHANGE. Upon completion of <br /> improvements that are necessary to establish a use on the site consistent with the B-2(B) zoning <br /> standards, the City shall give effect to the rezone by adopting an ordinance that makes the <br /> change to the zone boundary or zone classification on the Zoning Map that was approved in <br /> the Resolution of Intent to Rezone. Such an amendment to the Zoning Map shall be made by <br /> City Council adopting an Ordinance which specifically describes the property being rezoned. <br /> USE OF PROPERTY INCONSISTENT WITH THIS RESOLUTION - If any use of the <br /> subject property occurs which is inconsistent with the terms of this Resolution, either before, <br /> during, or after construction and installation of all improvements required by this Resolution, <br /> this Resolution shall become void and all entitlements to the uses permitted herein shall be <br /> forfeited. <br /> 2 <br />
