WHEREAS, the property is owned by the City of Everett, and is contiguous to the existing city <br />limits of the City of Everett; and <br />WHEREAS, the property is part of a larger mitigation/restoration area east of the Waste Water <br />Treatment Facility that is currently under the jurisdiction of Snohomish County for land use <br />permits; and <br />WHEREAS, a larger associated restoration/mitigation area extending west and south of the <br />subject property is currently inside Everett City limits, and therefore under permitting control of <br />the City; and <br />WHEREAS, annexing the property into the City will provide for more streamlined permitting, <br />urban services, and other benefits; and <br />WHEREAS, RCW 35.13.180 and 35.22.570 establish a process by which legislative bodies of <br />first class cities such as Everett may by a majority vote annex new unincorporated territory <br />outside the city limits for municipal purposes when such territory is owned by the city; and <br />WHEREAS, the Everett City Council has determined that the above-described process is the <br />most appropriate mechanism under state law to annex the portion of the MUGA located on <br />Smith Island and find that the proposed annexation is for a municipal purpose; and <br />WHEREAS, with the proposed annexation, the City will adopt proposed zoning and Shoreline <br />Master Program designations; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EVERETT, WASHINGTON <br />DOES RESOLVE AS FOLLOWS: <br />Section 1. The Everett City Council hereby states its intent to annex the unincorporated <br />Snohomish County territory on Smith Island via the process established in RCW 35.13.180 and <br />with 35.22.570 the omnibus grant of powers to first class cities. In order to qualify for <br />annexation under this method, an area must be of a municipal purpose and owned by the city. <br />The Smith Island property is owned by the City of Everett and is used for municipal purposes. <br />Section 2. The boundaries of the proposed Smith Island Annexation are depicted and described <br />in Exhibit B and Exhibit C to this resolution, respectively, which exhibits are attached hereto and <br />incorporated by this reference as if set forth in full. <br />Section 3. The City Council may adopt an ordinance approving the proposed Smith Island <br />Aniexation subsequent to a public hearing.
