On September 17 , 1989, the Hearing Pxaminer of the City of <br /> � 3dmonds granted a special property use permit (SPU M10-87) to the <br /> y Applicant for the construction of a 4 . 2 million gallon water <br /> storage tank on 3 . 16 acres in the 2300 block of 100th Street SE, <br /> Everett, Washington. As part of the special property use permit a � <br /> variance wae granted allowing the tank to �xceed the maximum <br /> height standards set Uy the City of Everett. The Applicant now � <br /> seeks a revision to the special property use permit with the grant <br /> of a variance to allow the Applicant to construct a fence in the <br /> front yard (south side) of the subject property. The variance <br /> requested is from the provisions of EMC 19 . 42. 030 which limits the <br /> height of iences in th=_ front yard to 42 inches (3 1/2 f.eetl . The <br /> Applicant seeks a variance to allow a 6 foot hiqh fence. (Staff <br /> Report) <br /> i �y z, The variance from the fence height is sought because the <br /> �_1 Applicant desires to provide security provisions for the water <br /> � <br /> tank facility. (Anderson Testimony) <br /> � �� 3. The subject property is zoned R-1 sinqle family low resi- <br /> ��� dential. (Staff Rep�rt) <br /> 4. The surrounding properties have the followir.g zoning and land � <br /> � use: � <br /> 1 ' - North and South; Snohomish County/residential I <br /> - East and West; R-1 residential <br /> � � 5. As set forth in the Everett Municipal Code, the Nearing I <br /> Examiner of the City of Everett has jurisdictional authority to <br /> make decisions on special property use permi.ts. If a special <br /> + 's� prcperty use permit includes a request for a variance, the Nearing <br /> e� 1 Gxaminer assumes jurisdiction over the variance . Ordinance <br /> q692-80, as amended, sets forth this jurisdiction. <br /> � I�� b .
