The request is for a revision to SPU p10-87 which allowed for <br /> the construction of a 4 . 2 million qallon water storage tank on , <br /> 3 .16 acres in the 2300 b�ock of 100th Street SE, Fverett, - <br /> Washington. The revision to the special property use permit is <br /> made for the allowar�ce of a variance to be issued for a fence on <br /> the front yard (soutt. side) of the subject property to exceed the <br /> standards as set fozth in EMC 19 . 42 .030. The variance requested <br /> is for the allowance c>f a 6 Loot high fence. <br /> 2, The tiearing Examiner of ttie City of Everett has ;urisdic- <br /> tional authority to hear this revision of the special preperty use <br /> ��� permit and of of variances based on the authority granted him in <br /> � Section 121A) of Ordinance p692-80. <br /> � 3. In order for a variance to be granted within the City of <br /> I �� Everett the criteria of EMC 19 . 70. 060 must be satisfied. That <br /> ��� criteri-a is satisfied i.n tnis case. <br /> q . Exceptions circumstances exist for the grant o: a variance <br /> because the Water District provides a utility service necessary <br /> �1' � for the people of the City of Everett. Some security precautions <br /> ` must Ue taken. A 6 foot high fence is reasonable under these <br /> circumstances. <br /> �� <br /> 5. The variance is necessary for the preservation and enjoyment <br /> of the property right of the Applicant . <br /> 6. The variance will not be detrimental to the public welfare <br /> ��1�� nor injurious to other properties in the vicinity in whicn it is <br /> located. <br /> 7.
