^ <br />FINDING3: The creek has an existing 30 inch culvert <br />providing access to the site. A 20 foot driveway will be <br />conatructed over the existing culvert and cross through the <br />adjoining wetland aree and required buffer area. Thie will <br />provide access to the dwellinq to be conatructed on the <br />southern portion of the site. The mitigation proposed by the <br />applicant 1s enhnncement of the creek at the location of the <br />croseing coneistinq of planting of the area with 25 red <br />oeier dogwood shrubs at 3 foot by � Poot spacing. Also, the <br />applicant ie proposinq to provide 2500 square feet of buffer <br />erea as mitiqation for the 2450 square feet of buffer impact <br />due to the driveway. This would consist of an additionel 55 <br />foot buffer from the wetland edge as meesured from the west <br />praperty line going east alonq the required wetland buffer <br />edge tapering doan to 75 feet as measured perpendicular to <br />the north buildinq setbnck line. As mensured perpendicular <br />to the north buildinq setback line this would provide for a <br />totel buffer width of 105 from the wetland edge and 155 feet <br />from the edqe of the creek tapering down to approximntely 85 <br />feet from the wetland edqe and 140 feet from the edqe of the <br />creek . A permanent fence will be constructed along the <br />entire edge of the buffer. <br />(7011CLU3ION3: The Planninq Director has made a <br />determinetlon that mitigation proposed for the creek <br />croasinq nnd encroachment into the wetland and buffer areas <br />for the drivewey ia permitted with the followinq conditions: <br />1. Neceasary building permits must be obtained by the <br />applicant from the City. <br />2. The wetland mitigatlon/buffer enhancement plan prepared <br />by Wetlend Reeources Consultants dated November 14, <br />1991, must he complied with. in eddition, the following <br />conditions must be complied with: <br />a. t,ppropriate <br />approved by <br />North Creek <br />erosion <br />the City <br />prior to <br />control measures muat be <br />and in place adjacent to <br />any construction. <br />b. Detailed construction pinns for the crosslnq of <br />North Creek must be approved by the City prior to <br />any construction. <br />c. Prior to any construction a permanent fence must <br />be placed alonq the entire edqe of the buffer. <br />
