4. The terms of the resolution are sufficient to mitigate the impacts of the praposed rezone. <br />NOW, THEREFORE. BE IT RESOLVED that the Ciry Council of the City of Everett declazes <br />its intent to rezone property located at 2?25 l 16th Street SE, a vicinity map of which is attached <br />hereto as Exhibit "A:' from R-1 (Single Family Detached Low Densiry) to B-L (Nei¢hborhood <br />Shopping), pursuant to the provisions of Section 41.160 of Ordinance No. 1671-59, as amended, <br />and the Council shall by Ordinance, effect such rezone upon being ,i�i�ised that all of the <br />following conditions, stipulations, limitations, and requirements contamed in this Resolution <br />have been met: <br />The future development of the subject property be permitted only as part of an integrated <br />redevelopment with adjoining B-1 zoned properties, to be further reviewed through the <br />City's shoreline permit process. <br />2, There shall be no vehicular or pedestrian access permitted to the site through the abutting <br />single family zoned property (Hauff property) located south of the subject property. <br />3. The south boundvy of the subject property (abutting the Hauff property) shall be fenced <br />with a solid fence eight feet in height constructed with a 6 foot wood fence on a? foot <br />concrete or mnsonry base. <br />4. The l0 foot wide landscape buffer abutting the property to the south of the subject <br />properry shall be planted with landscaping with trees having a mix of evergreen and <br />deciduous trees fortning a more substantial visual bufter than Type 11 Inndscaping would <br />provide. Trees shall be a minimum height of 8 feet at the time of planting. <br />5, The height of the cummercial building on the subject property be limited to l9 feet, with <br />azchitectural accents or features used to modulate the front facade of the building allowed <br />to have a height of up to 28 feet. <br />6. The pazking azea proposed on the east side of the subject property have a minimum <br />setback of 18 feet from the south property line (abutting the Hauff property), to be <br />landscaped as described above in Condition #4. <br />7. Conswction must be commenced within two (') years of the date of issuance of the <br />shoreline permit. An extension of time may be authorized as provided by the State <br />Shoreline regulations. Construction of buildings and of the site improvements required <br />by this Resolution shall be completed within five years of the date of issuance of the <br />shoreline perm�t. M extension of time may be audiorized as provided by the State <br />Shoreline regulations. <br />8. Use of Property Inconsistent with this Resolution. If any use of the subject property <br />occurs which is inconsistent with the terms of this Resolution, either before, during, or <br />after construction and installation of aIl imptovements required by this Resolution, this <br />Resolution shall become void and all entitlements to the uses permitted herein shall be <br />forfeited, and any use inconsisten� with the R-1 zoning of the property shall be deemed a <br />97 <br />z <br />17 <br />■ <br />
