•• 17 <br />RESOLUTION YO. <br />RE50LUTION OF INTENT TO REZONE <br />"KANERIS PROPERTY" LOCATED AT 2225 116TH STREET SE <br />FROM R-I TO B-I <br />WHEREAS, Geotge Kaneris filed an application w rezone propeRy located at 2'25 I 16th Street <br />SE from R-I (Single Family Detached Low Density) ro B-i (Neighborhood Shopping) for the <br />purpose of establishing a retail shopping center d:velopment, the Iegal description of which is: <br />The north 125 feet of Lots 5, 6 and 7 ef the <br />Silver Lake, as per plat recorded in V��lume <br />County. Situate in Section 20, T. 28 N., R. <br />Snohomish, State of Washington. <br />and <br />Re-Plat of Lots 14 and 15, Block 1, Plat of <br />9 of Plats, Page 77, Records of Snohomish <br />5 E., Willamene Meridian, in the Counry of <br />WHEREAS, the proposed development of the subject with commercial buildings could have a <br />detrimental impact on the single family residential zoned property abutting subject property to <br />the south; and <br />WHEREAS, the Plnnning Commission, after holding a public hearing, did adopt cenain <br />Findings, and recommened to the City Council that the proposed rezone be approved pursuant to <br />the provisions o£ Section 41.160 D.7 of Ordinance No. 1671-49, as amended, and subject to the <br />specific conditions set forth in said recommendation; and <br />WHEREAS, the Ciry of Everett, heteinafter referred to as "Ciry," finds that by establishing <br />certain stanuazds for the development of the property to be rezoned, that the residential property <br />abutting to the south of the sul�ject property can be adequately protected from the impacts of <br />commercial use of the property to be rezoned; rnd <br />WHEREAS, the Everett Zoning Code provides a mechanism by which the Ciry and property <br />owner may enter inro a"performance agreement" wherein the proponent of a rezone agrees to <br />develop property according ro tt.e terms of the ugreement be•fore the rezone is finalized by the <br />City;and <br />WHEREAS, the City Council fi.nds thar. <br />1. The proposed rezone is consistent with the Comprehensive Plan; <br />2. The proposed rezone bears a substantial relatioa to the public health, safety and welf,re; <br />3.
