MITIGATION AGREEMENT <br />THIS AGR�EMENT is made and entered into this 17ch day of <br />oecember, 19?0 , between EVERETT SCHOOL DISTRICT NO. 2 <br />("District") and Schneider Homes, Inc., a Washington corporation ("Developer"). <br />A. Developer has requested a project review for construction oi 113 single family <br />dwelling units known as Casper Creek Town Homes (the "Project"), Ci;y o1 Everett Filing <br />No. SEPA 92-89, located south ot Siiver Lake, west oi 191h Avenue SE, Everett, <br />Washington 2nd more particularly described as follows: <br />Legal Description: See ariached - Exhibit A <br />B. The S1ste Environmental Policy Ar,t ("SEPA") orovides processes and procedures <br />whereby major actions by state and local agancies, including, but not limited to, the <br />approval ol build�ng permits/plats, m2y be review@d ta determine the nature and extent <br />of their irnpact on the environment. Impacts on public: services, inc,uding schools, are <br />environmental impacis for purposes ol SEPA. SEPA requires the mitigation ot adverse <br />environment2l impacis. <br />C. The Project will be located in an area where school children residing therein wiil <br />be served by the District. <br />D, The District has identitied the impacts on the District that will be a direct result of <br />the construction ot the Project. <br />E. The identilied impacts include the projected addition o1 52.09 students to the <br />District, ol which 20.45 are unhoused. <br />F. The District projects that the middle/high school(s) serving the Project will be at <br />capacity when the students irom the Project enter school. As a result, the District will <br />have to provide space in portable classrooms and other school facilit(es in order to <br />house 2nd otherwise accommodate �hese students. <br />G. Dev�loper and the District have reviewed the mitigation measures reasonably <br />necessary to mit(gate the Impacts directly resufling irom the Project and have concluded <br />that the provisions set forth below In this Agreement constitute complete 1nd appropriate <br />provisions for tull mitigation by Deveioper o1 the identified (mpacts lrom the Project on <br />the District. • <br />H. Neither the <br />reduce or enlarge <br />conditlons ot the <br />righis•ot-way that <br />fmpacls identified nor the mitigation measures oHered herein alfect, <br />any other obligation Deveioper or the Project has to comply with all <br />includ(ng, without limitat(on, bus turnouts, sidewalks or pedestrfan . <br />benefit school children: ' . � ' <br />.
