MITIGATION AGREEMENT <br />THIS AGREEM�NT is made and entered into this �cn day ot <br />Decemb•r. 1990, between EVERETT SGFIOOL DISTRICT NO. 2 <br />("Dis'r �") and Schneider Homes, Inc., a Washington corporation ("Developer'), <br />� <br />A. Developer has requested a project review for construdion of 113 single family <br />dwelling units known as Casper Creek Town Homes (the "Project"), Ci;y of Everett F�lirg <br />No. SEPA 92•89, located south ot Sil �er Lake, west of 19th Avenue SE, Everett, <br />V/ashington and mure panfcularly described as follows: <br />Legal Description: See attached - Exhibit �1 <br />B. The Slate Environmental Pol(cy Act (`SEPf ") providas processes and procedures <br />whereby major actions by state and lacal agencies, Including, but not limited to, the <br />approval of building permits/plats, mxy be review@d to determine the nature and extent <br />of their impact on ths environment. Impacts on public services, including schools, are <br />environmental impacts tor purposes o� SEPA. SEPA requires the mitigation of adverse <br />environmental impacts. <br />C. The Project will be Iocalr,G in an area where schooi children residing t;ierr�in wiil <br />be served by the District. <br />D. The District has idenlHied the impacts on the District that will be a direct resuit ct <br />the construnion ai the Projec!. <br />E. The identi(ied (mpacts (nclude the projeded addit(on of 52.09 students to the <br />Dfstrict, ol which 20.45 ara unhoused. <br />F. The Dist�lct projads that the middle/hi9h school(s) servin9 the Project will be at <br />capacity when the studenta irom tha Project enter school.
