However, the Applicant objected to <br />the requirement that the public be gcanted lineal accees <br />along 2,000 feet oE shoreline and submitt?d that such a <br />reauirement is a takina of property without a compelling <br />public need, and, if taken, reauires that just <br />compensation for it be paid Cy �he City. According to <br />the legal memorandum, the City has no authority for the <br />requirement of lineal shoreline access. The State <br />Environmental Policy Act imposes strict limitations on <br />reauicements of lineal accesa and Silver Lake is not <br />included in bodies of water ceouiring such access. The <br />zoning Codes of the City of Everett do not provide a <br />detailed analysis of public shoreline needs and a lonc <br />c�nge plan which allows oc encourages foc aeauisition by <br />th� City of Everett oE the shoreline around Silver <br />i.ake. Further, neither Snohomish County nor the City of <br />Evn�ett hlaster Plans designates Silver Lake as a <br />�horeline of statewide signiEicance and Ordinance 723-80 <br />adopted on Anqust 27, 1980, �emoved Silver Lake as a <br />shoreline of state•�ride significance.
