Rockeries cannot be used for structural stability. (SEPA Earth and Water Policies) <br /> 11. Per the Amended Concomitant Agreement to Rezone Ordinance 1674-90, all slopes of <br /> 25% and greater are classified as Native Growth Protection Easements (NGPEs), unless <br /> otherwise approved by the City and CARE. No removal of vegetation is permitted within <br /> the NGPEs except as necessary to construct recreational trails and utility improvements. <br /> The detailed grading and site plans submitted to the Building and Public Works <br /> Departments for permit application must show the NGPE boundary as approved by the <br /> Planning Department and CARE. <br /> A 10 foot construction setback is required from the edge of tha agreed upon NGPE <br /> boundary. No portion of any structure which requires a continuous foundation or footing <br /> shall be permitted within the construction setback area: The following types of facilities <br /> shall be permitted in the construction setback area: decks, patios, yards, small rockenes, <br /> and residential landscaping. (SEPA Water, Earth, and Plant and Animal Policies) <br /> 12. Per city standards, a temporary construction fence or erosion control fence a minimum of <br /> four feet high must be placed along the edge of the NGF'E boundaries prior to the <br /> initiation of and Specifications) (SEPA Earth, Watery and Plant land alteration activities on the site. Covenants and <br /> restrictions shall run with the title and be a permanent restriction on future development <br /> and use of the property. <br /> Upon inspection by a qualified City tree expert, the City will allow for the cutting of trees <br /> within a dedicated Native Growth Protection tract or easement that are claimed to be <br /> hazards to adjacent structures. However, the trees must be cut and replaced per the <br /> conditions of the concomitant agreement to the rezone ordinance for the site at <br /> requesters' expense. This shall be noted in the recorded covenants. <br /> Sales agreements for all condominiums shall include information to the owners educating <br /> them about the sensitive areas and wildlife habitats adjacent to their properties. <br /> 3 <br />
