MELUM FOR APPROVAL OF A CITY OF EVERETT <br />MODIFICATION TO A PRELIMINARY PLAT Public Works Dept. <br />APPROVAL (COLBY PLACE) SUBD. #1-86 <br />DECISION: The preliminary plat approval of Colby Place is <br />amended to allow lot #13 to have a side yard <br />setback of 14' on the west side. <br />INTRODUCTION <br />On June 20, 1986, the Everett Hearing Examiner granted approval <br />of a 17 lot subdivision on property located east of Colby <br />Avenue and south of Madison and west of the PUD right-of-way in <br />the City of Everett, Washington. The preliminary plat approval <br />was granted subject to conditions. Included in the conditions <br />of approval was condition I(C) which required lot #13 to have <br />minimum setbacks shown on the face of the plat of 20' on the <br />entire southeast side, 20' on the west side, and 6' on the <br />north side. The Applicant has requested modification to allow <br />the west side of lot #13 to have a side yard setback of 14'. <br />A hearing on the request was held before the Everett Hearing <br />Examiner on June 24, 1987. Applicant's Narrative Statement of 4/27/87 <br />After due consideration of the evidence presented by the <br />Applicant; evidence elicited during the public hearing; and as <br />the result of the personal inspection of the subject property <br />and surrounding areas by the Everett Hearing Examiner, the <br />following findings of fact and conclus'ons constitute the basis <br />of the decision of the Everett Hearing 2xaminer. <br />
