On June 20, 1986, the Ilieret•t Hearing Examine )red <br />a 17 lot subdivision for property east of Colby ue, <br />south of Madison and west of the POD right-of-way in the <br />City of Everett, Washington. <br />2. The request was granted subject to conditions including <br />condition I(C). That condition required that lot 13 of <br />the plat have minimum setbacks shown on the face of the <br />plat as 20' on the entire southeast side, 20' on the <br />west side and 6' on the north side. The Applicant seeks <br />to modify this plat approval by reducing the side yard <br />setback on the west side of lot #13 to 141. (staff <br />report, Anderson testi.mony) <br />3. Admitted as exhibit 3 to the hearing was the recorded <br />plat map of the subdivision. Lot 13 was the last lot to <br />be developed of the subdivision. Lot 13 as shown on the <br />plat map is a triangular shaped lot that has limited <br />open space. (exhibit 3) <br />4. A driveway was constructed frr lot #13 to access 70th <br />Place S.E. The driveway w,,s constructed before any <br />development of the lot:. ,+: is the intent of the <br />Applicant to reduce the west side yard setback to 14' in <br />order to create more open space and to utilize the <br />existing driveway. (Anderson testimony) <br />5. Although the reduction of the setback will reduce the <br />open space in the west, the open space on the north <br />portion of the lot will be increased to a 45' setback <br />from the structure to the int :section of the two lot <br />lines. (Anderson testimony) <br />6. Lot 13 contains 7,730 square feet of lot area. It has a <br />lot width of 60' or more. The lot satisfies the R-1 <br />zoning requirements. The Everett Planning Department has reviewed the <br />proposed lot modification and has determined that it <br />satisfies all of the criteria and guidelines for <br />approval of proposed subdivisions as set forth in <br />Everett Subdivision Ordinance, Section 4.C.3.
