Subdivision ordinances of the City of Everett have been <br />reviewed and the proposed modification is consistent <br />with the policies as set forth in the ordinances. <br />3. The modification of the lot line of lot #13 is <br />consistent with Section 6.8.5 of the subdivision <br />ordinance of the City of Everett. <br />4. Exceptional circumstances necessitate the modification <br />of the lot line of lot #13 of Colby Place. Because of <br />the design of the lot and the design of other lots in <br />the area, a reduced lot line is necessary to increase <br />the open space on the lot. <br />5. The requested lot line modification will not be <br />injurious to the adjacent• properties. <br />6. The Applicant will be able to utilize an existing <br />driveway that has been constructed. Without the lot <br />line modification, a hardship will exist because this <br />driveway will have to be replaced. <br />DECISION <br />Based upon the preceding Findings of Facts and Conclusions, and <br />upon the imrressions of the Everett Hearing Examiner upon a <br />site view, it is herehy ordered that condition # I(C) is hereby <br />amended to read as follows; <br />The following minimum setbacks must be shown on the face of the <br />plat (see the attached plot plan): <br />Lot 13 20 feet on the entire southeast side, 14 feet on <br />the west side. <br />This modification is granted subject to the following <br />conditions: <br />1. The dwelling to be constructed on lot 13, plat of Colby <br />Place, shall provide for yard depths as shown on the <br />attached plat plan exhibit. Specifically, a ;minimum <br />depth of 20 feet from the front yard, a minimum depth of <br />45 feet from the rear yard, a minimum depth of 14 feet <br />from the west side yard and a minimum depth of 7 feet <br />from the east side yard. <br />Done and dated this 1st day of July, 1987. <br />s M.
