The drainage for lot #13 will be <br />collected by the plat drainage syst?m previously <br />approved and constructed. (staff report) <br />9. When the lot is developed, Lot #13 will not exceed the <br />maximum gross floor area ratio of .30. There is <br />adequate open space. (stiff report) <br />10. The proposed modification will have no negative impact <br />on public health, safety or welfare. <br />11. Section 6A.5 of the Subdivision Ordinance of the City of <br />Everett sets forth guidelines for approving <br />mod?.fications. Included in these guidelines <br />A. There must be a showing of special circumstances; <br />B. It must not be injurious to the adjacent <br />properties and must not be contrary to public <br />welfare; and <br />C. There must be a hardship shown if the modification <br />'s not granted. <br />12. Because of the unique configuration of the lots within <br />the subdivision, lot #13 was developed in a triangular <br />shape. Because all the other lots aLe developed, their <br />property lines cannot be readjusted to create a more <br />open space for lot #13. These are exceptional <br />circumstances necessitating a modification. (staff <br />report, Anderson testimony) <br />13. If the modification is not granted, the Applicant .has <br />indicated that the proposed placement of the residence <br />will be difficult. Apparently, the proposed placement <br />of the residence on site can only be done through <br />modification of the lot line. (Anderson testimony, <br />staff report) <br />CONCLUSIONS <br />1. The Applicant has requested a modification to the <br />building setback line for lot #13 of the plat of Colby <br />Place which was approved on June 20, 1986 by the City of <br />Everett. The modification is for a reduction cf the <br />required 20' west side yard setback to a side yard <br />setback of i4'. <br />
