<br />; (10) The Contractor further agrees to save tlie City, its officers,
<br />� employees and agents harmless from all loss, damage or injury,
<br />i including death, occasioned to it or to any tliird person or
<br />� ' property by reason of any acts or omissions on the part of the
<br />; Contractor, subcontractor, agents, employees, or persons working
<br />directly or indirectly in tlie performance of the Contract and
<br />shall, after reasonable notice thereof, defend and pay the
<br />! expense of defending any suit wiii�h may be commenced against the
<br />C1ty, its officers, employees or agents by any third person
<br />alleging injury by reason of sucli acts or omissions and will pay
<br />any judgment which may be obtalned ayainst tlie City, its
<br />officers, employees or agents in such suit. The Contractor
<br />agrees to repair and replace all property of the City and
<br />property of otliers damaged or destroycd by liimself, his employees
<br />and subcontractors and agents. lliis paragrapl� does not purport
<br />to indemnify the City against liability for damages arising out
<br />� of bodily injury or deatl� to persons or damages Lo property
<br />' caused by or resulting from the sole negligence of the City, its
<br />officers, employees, and agents; PI�OVIUEU, tliat if the claims or
<br />damages are caused by or result from tlie concurrent negligence of
<br />(a) the Contractor, its subcontractors, its agents or employees,
<br />and (b) the City, its officers, eniployees or agents, this
<br />indemnity provision sfiall be valid and enforceable only to the
<br />extent of the negligence of the Contractor, its subcontractors,
<br />its agents or employees. (For examplc, wiiere tfie Contractor is
<br />25% liable, thls indenuiification shall extend to 25% of the
<br />'. City's concurrent negligence, if any.)
<br />(11) The Contractor expressly agrees to pay all premiums provided for
<br />by tlie Workman's Compensation Act of tiie State of Wasliinyton.
<br />(12) The Contractor furtlier agrees to comply witli the provisions of
<br />RCW 39.16.005 concerning percentage of resident employees.
<br />(13) lt is understood that the wiiole of tlie work under tliis Contract
<br />is to be done at tlie Contractor's risk, and that fie has
<br />familiarized himself witli tl�e conditions of demolition,
<br />excavation, backfill, materia�s, climatic conditions, and otlier
<br />contingencies likely to affect tlie work, and has made liis bid
<br />accordingly, and that he is to assume the responsibility and risk
<br />of all loss or damage to materials or wurk wliich may arise from
<br />any cause whatsoever prior to cowpletion.
<br />(14) Contractor shall secure and malntain d w•iny ti�e life of this
<br />Contract minimum Public Liability and Property Uamage lnsurance
<br />Coverage in the minimum amount of b5U0,0U0 for death or injury to
<br />any one person and S1,UOU,UUU for death or injury to two or more
<br />persons in any one uccurrence and 1�IUU,UUO for Property Uamage in
<br />any one occurrence with any a99regate Property Damage coverage of
<br />E10U,0UU for two or more occurrences from an insurance company
<br />authorized to do business in the State of Washington. Said ,
<br />insurance coverage may be superseded by addenda or other
<br />provisions of the Contract. City, its officers, employees and
<br />agents shall be an additional named insured on said insurance in
<br />a form acceptable to the City Attorney.
<br />(15) The Contractor shall secure all municipal, county or state
<br />permits or licenses necessary or incident to tlie actual
<br />performance of the work under this Contract, and shall, duriny
<br />its progress, comply with all laws, ordinances, and governmental
<br />regulations pertaininy to carryiny out of �hc work.
