rw� � <br />(16) The Cuntractor shall not be entitied to any claim for damages or <br />of hindrances or delays from any cause wliatsoever, but 1f <br />occasioned by any act of God, or by any ar,t or omission on the <br />part of the City, sucli act, liindrance, or delay may entltle the <br />Contractor to an extension of time in wfiich to complete tlie work <br />which sliall be determined by tl�e auilding Official, PROVIUED THAT <br />tlie Contractor will give notice in writing of the cause of such <br />act, hindrance, or delay witliin ten (10) days after its <br />occurrence. . <br />(17) The Contractor agrees to comply witli RCW 49.28.020, .060, .110 <br />prohibiting the employment of employees more than eight (8) hours <br />in any one day, except in c. e of eniergency, and provided that <br />said Contract is ter�ninable in case tlie Contractor shall violate <br />the provisions of such act. <br />(18) The Contractor agrees to pay all taxes and assessments due the <br />State of Washington or any subdivisicr, tliereof, and to furnish to <br />tiie City a certiflcate from tlie Tax Cominlssion of the State of <br />Washington tliat all taxes, increase and penalties due from the <br />Contractor and all taxes due and to become due with respect to <br />such Contract have been paid in full. <br />(19) The Contractor shall, at fiis own expense, provide flagmen, shall <br />furnish all signs, barricades, guards, construction warnings, and <br />niglit ligf�ts in order to protect tlie public at a'1 times from <br />injury as a result of liis operations. <br />(20) The Contractor shall be responsible for controlling dust and mud <br />within Llie project limits. Tlie Contractor shall be prepared to <br />use watering trucks, power sweepers and any other pieces of <br />� equipment necessary to avoid creating a nuisance. Al1 roads used <br />� b,� his operation shall be thorou9hly cleaned at the end uf each <br />work day. Any damage caused by dust and/or mud shall be the sole <br />� responsibility of the Contractor. <br />, All work required by tliis Section shall be considered tu be <br />incidental to other items of work, and no extra payment shall be <br />made for dust and mud control. <br />(21 ) An, notice from one party to tlie otlier party under the Contract <br />shall be in wriNng and shall be dated a�id signed by the party <br />giving such notice or by tfie duly autliorized representative of <br />such party. Any sucli notice as lieretofore specified sliall be by <br />personal delivery tliereof or by depositing same in tlie United <br />StatEs Mail, postage prepaid and registered. <br />(22) Li the event a ciaim shall be filed ayainst the City grrowing and <br />arising out of the performance of tlie Contract by tlie Contracter <br />whether baseless or not, the City shall have the right to retain <br />from the sum due the Contractor sufficient money to satisfy the <br />claim until said claim lias been witlidrawn or Jismissed by a court <br />of competent jurisdiction. Tlie City sliall not be liable for <br />interest during the period the fdnds :.... so held. <br />(23) The Contractor should carefully �,.•�m:� � Rule 111, issued by the <br />WaslNngton State Tax Coinnission, to dec�.�mine whether or not the <br />City sliall be required to pay a sales tax on tlie work to be <br />performed, or shall be exempt from sales tax. In the event the <br />City is exempt from sales tax, tlien the Contractor should be <br />careful to ascertaln the tax applir.able to his pe�chases. <br />(24) The prevailing rate of wages to bc paid to all workmen, laborers, <br />or mechanics employed in the performance of any part o( this <br />Contract shall be in accordance with the provisions of Chapter <br />39.12 RCW, as amended.
