The variance is necessary in order to resolve the ongoing <br /> noise problem. <br /> Conclusion: The variance is not the result of a self- <br /> created hardship. <br /> DECISION: <br /> The Everett City Council hereby grants approval of the Expansion <br /> of the Nonconforming Building/Use Permit #1-93 and Variance #11- <br /> 93 for the proposed 4,860 square foot restaurant expansion, with <br /> the following conditions: <br /> 1. Any grading/fill on this site shall be done so as to not <br /> impact the surrounding properties. <br /> 2. The proposed building addition must incorporate <br /> recommendations for noise reduction contained in the <br /> acoustical study dated June 1993, prepared by M. Yantis and <br /> Associates. In addition, all mitigation measures <br /> recommended in the supplemental noise analyses dated August <br /> 12, 1993 and August 25, 1993 must be implemented to ensure <br /> compliance with the City's Noise Ordinance. <br /> 3. The soundstage and dance floor must be relocated from the <br /> existing building to the proposed addition. <br /> 4. The existing restaurant is operating in violation of the <br /> City's Noise Ordinance. In addition to the conditions of <br /> approval of this decision, the Hearing Examiner and/or <br /> Everett Municipal Court may impose further restrictions, or <br /> may impose fines. <br /> 5. Detailed drawings in accordance with City Design and <br /> Construction Standards shall be submitted to the Public <br /> Works Department showing site parking layout, landscaping, <br /> utilities, storm drainage, and temporary construction <br /> erosion control. Public Works Department approval of these <br /> drawings is required prior to any permits being issued. <br /> 6. Special charges for connection to the sewer and water <br /> systems in accordance with Ordinance 1171-85 and subsequent <br /> revisions are applicable. These charges are based on <br /> projected water usage and can be substantial. The Applicant <br /> is encouraged to obtain a copy of the Ordinance and <br /> determine estimated charges prior to building permit <br /> application. The actual charges shall be computed by the <br /> Public Works Department per the ordinance in effect at the <br /> time and according to the information on the approved plans <br /> at the time of building permit issuance. <br /> 7. Parking must be per City Zoning Code and City Design and <br /> Construction Standards and Specifications. For the total of <br /> 8 <br />
