Jurisdiction: The Hearing Examiner of the City of Everett has jurisdictional <br /> al:thority to hold a hearing and to issue the derision. That authority is set forth <br /> in EMC 2.23.120. Based on the above Findings of Fact, the Hearing Examiner <br /> enters the following Conclusions: <br /> CONCLUSIONS <br /> 1. The Applicant requested approval of a Special Property Use Permit for <br /> the installation of a 180-foot high steel communication tower on property <br /> located at 319-76th Street SW, Everett, Washington. The proposed steel <br /> tower will replace an existing 148-foot high steel tower. The antennas on <br /> the existing tower will be relocated to the proposed tower. As part of the <br /> project, the Applicant proposes to construct a 12' by 34' equipment <br /> building on-site. (finding 1) <br /> 2. In order for a Special Property Use Permit to be granted within the City of <br /> Everett, the General Evaluation criteria of EMC 19.41.150.0 must be <br /> satisfied. (finding 7) The manner in which each of these criteria is <br /> satisfied is set forth in findings 8-22. <br /> 3. In addition to the General Evaluation criteria, the Specific Evaluation <br /> criteria of EMC 19.41.150.D.1.c must be satisfied. (finding 23) The <br /> proposal satisfies these criteria in the manner set forth in finding 23 and <br /> the cited findings therein. <br /> 4. The reduction of the required 180-foot setback of the towers from the <br /> closest residential properties is reasonable. Because of the long-term <br /> use of the site for towers, as well as the available natural screening, the <br /> reduced setback is justified. <br /> DECISION <br /> Based upon the preceding Findings of Facts and Conclusions, testimony and <br /> evidence submitted at the public hearing, and upon the impression of the <br /> Hearing Examiner at a site view, it is hereby ordered that the requested Special <br /> Property Use Permit for a 180-foot steel communication tower as a replacement <br /> of an existing 148-foot steel tower is granted. The new tower shall be placed on <br /> the property at 319-76th Street SW, Everett, Washington. The antennas on the <br /> existing tower are to be relocated on the new tower. The Special Property Use <br /> Permit also allows for a 12' by 34' equipment building to be located on the site. <br /> The Special Property Use Permit is granted subject to the following conditions: <br /> 1. The proposed tower must be painted gray. <br /> 9/d <br />
