RESOLUTION NO. 3734 EVERETT <br /> RESOLUTION OF INTENT TO REZONE <br /> "HARRINGTON PROPERTY," 8220 BEVERLY BOULEVARD <br /> A Resolution of the City of Everett Approving a Development Proposal <br /> Located at 8220 Beverly Boulevard, and Setting Forth Conditions to <br /> Which the Development Proposal shall be Subject, and Declaring Its <br /> Intent to Rezone said Property from R-1 to B-i upon Approved <br /> Completion of Certain Specified Improvements on the Subject Property. <br /> WHEREAS, Carole Harrington has filed an application to rezone property <br /> located at 8220 Beverly Boulevard from R-1 (Single Family Low Density) <br /> to B-1 (Neighborhood Business) for the purpose of establishing a <br /> retail business; and <br /> WHEREAS, the B-1 zone allows uses which could have a detrimental <br /> impact on the single family residential zone abutting the subject <br /> property to the north; and <br /> WHEREAS, the Planning Commission, after holding a public hearing did <br /> adopt certain Findings and did recommend to the City Council that the <br /> proposed rezone be approved pursuant to the provisions of Section <br /> 41.160 .D.7 of Ordinance 1671-89 , as amended, and subject to the <br /> specific conditions set forth in said recommendation; and <br /> WHEREAS, the City of Everett, hereinafter referred to as "City," finds <br /> that by limiting the permitted uses of the subject property and by <br /> establishing certain standards for the development of the property to <br /> be rezoned, that the residential property abutting to the north of the <br /> subject property can be adequately protected from the impacts of <br /> commercial use of the property to be rezoned; and <br /> WHEREAS, the Everett Zoning Code provides a mechanism by which the <br /> City and property owner may enter into a "performance agreement" <br /> wherein the proponent of a rezone agrees to develop property according <br /> to the terms of the agreement before the rezone is finalized by the <br /> City. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br /> Everett declares its intent to rezone property located at 8220 Beverly <br /> Boulevard, the legal description of which is: <br /> Lot 15, Block 5, Beverly Park, according to the Plat <br /> recorded in Volume 8 of Plats, page 24 , records of Snohomish <br /> County, Washington; except the following described portion: <br /> Beginning at the southeast corner of said Lot 15; thence, <br /> northerly along the easterly line of said Lot 15, for 8.0 <br /> feet; thence, southwesterly in a straight line of said Lot <br /> 15 , which is 10 .0 feet westerly of the southeast corner <br /> thereof; thence, easterly along the southerly line of said <br /> 1 <br />
