Resolution shall be presented to the City Council for their <br /> consideration and approval. If the requirements specified herein <br /> are not completed within one year of the date of the adoption of <br /> this Resolution by the City Council, this Resolution shall become <br /> void and all entitlements to the uses permitted herein shall be <br /> forfeited, and any use inconsistent with the R-1 zoning of the <br /> property shall be deemed a violation of the zoning code and be <br /> subject to the violation, enforcement and penalty provisions <br /> thereof. <br /> b. Construction of a New Commercial Structure. In accordance <br /> with City regulations, the applicant may remove the existing <br /> structure from the property for the purpose of constructing a new <br /> building to be used consistent with the terms of this Resolution. <br /> If the existing structure is removed from the premises and a new <br /> structure is built for commercial purposes, all improvements <br /> required by this Resolution and other City regulations shall be <br /> completed within one year of the date of issuance of building <br /> permits. Upon completion of the parking lot and landscaping <br /> improvements in accordance with the terms specified herein, a <br /> rezone ordinance consistent with this Resolution shall be <br /> presented to the City Council for their consideration and <br /> approval. If all required permits are not obtained and the <br /> construction of a new building is not commenced within two years <br /> of the date of adoption of this Resolution by the City Council, <br /> this Resolution shall become void and all entitlements to the <br /> uses permitted herein shall be forfeited, and any use <br /> inconsistent with the R-1 zoning of the property shall be deemed <br /> a violation of the zoning code and be subject to the violation, <br /> enforcement and penalty provisions thereof. <br /> 10. Use of Property Inconsistent with this Resolution. If any use of <br /> the subject property occurs which is inconsistent with the terms <br /> of this Resolution, either before, during, or after construction <br /> and installation of all improvements required by this Resolution, <br /> this Resolution shall become void and all entitlements to the <br /> uses permitted herein shall be forfeited, and any use <br /> inconsistent with the R-1 zoning of the property shall be deemed <br /> a violation of the zoning code and be subject to the violation, <br /> enforcement, and penalty provisions thereof. <br /> 11. A copy of this Resolution shall be recorded with the Snohomish <br /> County Auditor's Office. All conditions, limitations and terms <br /> specified herein shall be binding upon the property and all <br /> future owners, heirs and assigns with any interest in the <br /> property described herein. <br /> 4 <br />
