The Special Property Use Permit will not be disruptive to the community <br /> and will have no serious adverse impact on the environment of the <br /> zH community. <br /> (A 6. 'There is a public need for the proposed facility and will be in the <br /> g C❑w public's convenience located in its proposed area. <br /> t�� DECISION <br /> H-3 to <br /> H o rn Based upon the preceding Findings of Facts and Conclusions, the testimony and <br /> evidence submitted at the public hearing, and upon the impressions of the <br /> Everett Hearing Examiner of a site view, it is hereby ordered that the <br /> requested Special Property Use Permit for construction of a golf driving range <br /> on a nine acre portion of property located east of 16th Avenue West and north <br /> of 80th Street SW is granted subject to the following conditions: <br /> 1. 'fie site must be developed in a manner consistent with the site plan <br /> presented at the public hearing (Exhibit 6). Minor modifications to <br /> the site plan may be approved by the Planning Director. If the <br /> Planning Director determines a proposed revision to be major, a new <br /> hearing must be held by the Hearing Examiner. <br /> 2. The Applicant must comply with all conditions listed in the <br /> CZ Determination of Non-Significance for the proposal (Exhibit 4) . <br /> ' 3. Netting must be provided around the driving range to keep errant golf <br /> CJ balls from adjacent properties. <br /> Done and dated this 14th day of November, 1988. <br /> James M. Driscoll <br /> 'The decision on this application has been made by the Hearing Examiner based <br /> on the authority granted in Ordinance 692-BO as amended. It is final unless <br /> the following procedure is followed: <br /> Ll I 1 . Any party aggrieved by the Everett Hearing Examiner's decision may file <br /> i a written request with the Examiner for reconsideration within ten (10) <br /> working days of the date of the Examiner's decision. The request shall <br /> explicitly set forth alleged errors of procedure or fact. The Examiner <br /> I\LO shall act within ten (10) working days after the date of the filing of <br /> the request for reconsideration by either denying the request, issuing <br /> a revised decision or calling for an additional pu!jlic hearing. If an <br /> additional hearing is called for, notice of set hearing shall be mailed <br /> to all parties of record not less than five (5) working day prior to <br /> the hearing date. The final date for requesting reconsideration is <br /> November 30, 1988. <br />
